My six-year H1B expires Feb 2 2010.
My employer (company A) filed PERM with DOL on July 30 2009.
I have spent a total of 2 months outside the U.S while on H1B status.
I have been on bench since July without paystub.
I am leaving the U.S on October 30 2009 and am interested in returning back
through another company
Can I return to the U.S through another employer (company B) on a new H1B visa after Feb 2 2010... How long would that visa be valid for.
If I cannot get a new visa; can I add the total of 5 months spent outside
the US on the current h1b visa for recapture through another employer (company B) after Feb 2 2010 -- return to the U.S; and then
subsequently apply for a 1-year extension after July 31 2010
based on company A's PERM filing.
thanks

Just got an email from Expedia.com - fares from Bay Area to Wash. D.C. have dropped by about $50 - the cheapest fares today (9/06/2007):
- SFO - BWI (US Airways) $208
- OAK - DCA (ATA): $218
- SJC - BWI (Continental): $218
The fares shouldn't be a reason to not participate in the rally! Hope to see more folks from CA - Norcal & SoCal.
cheers!

Just saw this story from a few days ago. Aside from being a hugely irresponsible way to spend a broke state's taxpayer funds, this idea also is probably unconstitutional. Does Arizona plan on having its own border control points? Will the state's wall interfere with Border Patrol activities? The federal government is supposed to control the national borders and not the states. Not that Arizona minds wasting the state's money to continue to losing that point.

The couple applied for the green card together. The husband applied under the EB1 category and his wife also applied with him as dependent. The green card of the couple has been approved and is expected to arrive in a month's time. The wife is not in US currently. She is outside US. Will the husband get his green card & the wife's green card in his wife's absence? Will there be any complications in the husband's green card in this case?
It is urgent. Please reply as soon as possible.

Since the early days of this blog, I've chastised immigration bureaucrats who use specious reasoning to treat small businesses petitioning for employment-related immigration benefits more harshly than their large-cap counterparts. The latest assault on fairness and reason is reflected in a trend affecting several categories of employment-based visas -- the H-1B (Worker in a Specialty Occupation), the L-1 nonimmigrant (Intracompany-Transferee Manager or Executive) and the EB1-3 (Multinational Manager or Executive). An example of this trend is a recently released EB1-3 decision (decided May 1, 2009) of the USCIS Administrative Appeals Office (AAO) denying an immigrant visa petition for a multinational...

I think if she didn't indicate that she intended to do CP in her I-140, but rather indicated she intended to do AOS in the US, then it will be a pain in the neck to switch to CP

The third of three immigrants on the the Presidential Council of Advisors on Science and Technology is Professor Ahmed Zewail, the winner of the 1999 Nobel Prize in Chemistry. Dr. Zewail is a professor of Chemistry and Physics at Caltech and is the Director of Caltech's Physical Biology Center. Dr. Zewail describes his research as follows: [The Nobel Prize was awarded for] pioneering developments in femtoscience, which made it possible to observe atoms in motion, the transition states of molecular transformations. This work created the discipline of femtochemistry, which is concerned with molecular reactivity on the femtosecond (1015 s) timescale....

To Experts and Attorneys,
I have a question regarding AC21 portibility. I got my EAD in Oct 12th 2007. In the labor(used a pre-approved labor), the base pay mentioned is 48K and I was getting paid 55K from my current employer(A) who filed my green card.
I am getting another job in company (B) in the same field. The salary offer is better but is very high than mentioned in my labor. The new salary is around 85K.
1) Will the high salary will cause any issue with green card process if I take AC21 and use my EAD. Anyone had this kind of experience with the salary difference.
2) How do I know my new job is in the same or similar category as defined by USCIS.
3) Is AC21 is safe to take.
Thanks.....

Hi Friends,
I have been cheated by a desi consulting company e-Data experts located in Harrisburg, PA. They applied for my labor in December of 2007 and it was audited and finally I was told in June 2010 that it was denied. Actually it was denied in January 2010 but they did not reveal this information intentionally. Now I am in my 6th year of my H1b which expires in March 2011. Can someone help me out how to sue the company for not revealing the information and firstly how can I stay in the country. BTW I have done Masters here and I am with another company now. Appreciate all your suggestions.
Thanks,
RK

One of the most reliable pundits when it comes to the math side of politics is the New York Times blogger Nate Silver. He actually comes from a sports background and was known as a master of sports statistics. I've been reading his five thirty-eight blog for the last couple of years and he's usually right on the mark. Nate has done some number crunching to verify claims that Latinos were undercounted in the polls and gave Democrats the margins needed to win in states where they have the largest populations. His finding? Indeed, the NCLR polling I wrote about...
