The following news items suggest there would be a serious attempt to pass CIR early in 2009 in both the houses of congress. That makes DC rally really more important as we just cannot afford to let even a single Durbin/Grassley provision to slip into CIR.

California taxpayers need to cover higher fees of private lawyers, who are hired by the state as the Attorney General's Office doesn't have the staff to handle all of the cases internally. In some instances, the state has employed outside counsel at hourly rates that reach $450 even while most of its in-house lawyers earn less than half that. Rates can be much higher, if the suits require private attorneys having a particular expertise.
Since January 2008, the Department of Corrections and Rehabilitation has signed about $24 million in contracts with private lawyers hired because the Attorney General's Office says it's too shorthanded to take the jobs. The corrections department is seeking the additional help despite having about 80 lawyers of its own to handle a gamut of cases, with about a dozen of those assigned to prisoner-filed litigation.

Hi
My 485+140 is currently with my lawyers for filing.
In the meantime, my wife's dates went current. Her lawyer says it is ok to apply her 485 and it is preferred so we have a backup.
However, BCIS might get confused and ask us to pick one 485 at a later date - but the lawyer advises to file it now and face it later.
1) Has anyone does this?
2) Should my wife apply EAD and AP as well or just 485?
3) What are the problems I should expect?

I am waiting for the approval of my I-131. Can I fax a request to approve/speedup the process? If I can send the fax, can someone pass the fax number?
Background:
I applied for I-131 online in May, 2008 at TEXAS Service center. I applied before 120 days of the expiration. In December 2008 I got an RFE asking for the reasons why I applied before 120 days of expiration of AP authorization. I sent the response on Dec 11th.

As far as I know one of my friend did the same thing. His new H1B transfer (premium processing) got approved and his original extension petition is still pending.

Hi,
My employers are considering transfering me to another group company (different name) during the next 1-2 months. My job profile will remain unchanged, but the employer name/address (on paychecks, etc) will be different after the transfer. My I-140 is still pending (filed in Aug 2007 together with I-485 at NSC under EB-3).
I'd greatly appreciate anyone's advice on the following:
a) If I transfer before my I-140 is approved, do I need to notify USCIS in writing? If so, does any specific paperwork need to be filled out? My employers have assured me they will continue to support my I-140/485 under the original company name, for as long as required.
b) If I transfer after approval of I-140 (fingers crossed!), do I need to notify USCIS? Again, is any specific paperwork necessary?

Hi Sukhpreet, are you sure the actual petition was filed and denied, or just the labor condition application (LCA) was denied? The LCA is one component of the H-1B petition; it requires a valid FEIN number, and it needs to be certified in order for the H-1B petition to be filed. Most likely, this is what has been denied because the DOL could not find/match the number. The lawyer can just refile the LCA with the appropriate IRS documentation, and it should be certified within a week. The H-1B petition can then be filed with the certified LCA.

Hello all, with the August bulletin showing June 06 cut-off dates, I have the following questions for which I seek input form IV members.
1. Is it possible to apply for the GC, the second time, if one cancels his GC "without prejudice"?
2. If yes, is it possible to use the priority date of the canceled GC in the second GC application?
3. What are the points one should be aware in canceling GC "without prejudice"?
