Right now I am on my 5th year of H1B with company A. If I file for labor with Company B and got approved in a year with out holding a H1 in Company B . can i get 7th year h1 extension with company B as they already have my labor approved? any inputs will be a great help. thanks in advance.

You can't leave the country while your AP is pending unless you have a valid (unexpired) H/L or any other visa that you could use to enter the country.

Can someone confirm if 1 year of OPT training also counts towards work experience? My friend needs to know since he needs to apply for Labor Certification and wanted to find out if this experience can be counted apart from the H1-B working experience.

There has been an error in the processing of my I-130 petition for my mother. It was approved and now I am being asked to submit form I-485 or form I-824. The problem is that my mother is not and has never been to the US. I called CIS and talked to a representative about the error. She said she would send a letter to the CIS about it and that I should hear back from CIS in 5 days. I am just wondering if this timeline is realistic or I should expect it to take more time. Should I contact my senator and ask for assistance in facilitating this process? Would hiring a lawyer expedite this process? I know that the petition should then go to the NVC. Would a lawyer help?

It can be done in Swift 3D. First, create a box. Then create a pyramid shape and place it above the box. Color the pyramid red and the box a white or brown. You now have a house. USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. Thanks to IV for making the multi year EAD/AP happen. Since USCIS might or might not announce this, I want to track when people start getting these multi year EAD/APs. Anyone in the IV community got one of these yet?

Hi Friends,
My AP is expering next month(NOV), I don't have any travel plans for next 1 year. i'm planing to apply in 2010 not now.
do i need to apply for extesion for evey year, if don't need also?

There is no AP renewal. You can apply AP later if you are not planning to travel. But AP is for travel during emergencies. It takes time to get the AP approval. Hence people keep it current all the time.

Massachusetts Republcian Scott Brown's web site has a pretty harsh position paper on immigration - the typical tea party-esque xenophobia one expects from the far right. All about enforcement and nothing about dealing with the millions of immigrants currently hear without status (other than deporting them all) or reforming our broken legal immigration system. Brown has been portraying himself as a moderate, but those in the Bay State who consider themselves pro-immigration should pay heed. More telling is the ringing endorsement Brown got from anti-immigrant ALIPAC. Hopefully, Brown will either lose or he's planning on taking a more moderate approach...

This shouldn't be a problem provided that she has the AP when she is leaving. AOS applicants don't need to be in the US while the AOS is pending, except to go to fingerprint appointments, interviews, etc. They must be in the US when the AOS is filed, and need to be careful to always have AP before leaving, but a 3-month gap should not be a problem.

My Situation:
I am on H1B visa and working now with employer �A� (from Jun 10 to Till Date)
I was working with employer �B� (from Jun 09 to Jun 10)
I was previously also working with employer �A� (which is now my present employer) from Jul 08 to Mar 09,
My H1 Transfer from employer �B� to �A� has been filed in last Jun 10 but it is in Process now.
Now my present project is over, I have got a project with employer �C�
My Questions:
1. Can I join the employer �C� by filing another H1 transfer? as of now still my H1 Transfer (employer �B� to employer �A�) is in process.
2. I have also got another project with my ex employer �B�, I can see the I797 petition of the employer �B� is still showing a status of approved in the USCIS state, it has not been reoked. Can I rejoin the ex employer �B� without filing any new H1 Transfer ( from employer �A� to employer �B�).
Will appreciate your answer,
