    My dear friend you don't understand a thing, and are poorly informed!

    EB visas account for only 14% of total visas awarded. Those previous "hallowed" GCs you lament about, have been given to countless refugees, asylees, Family Based Immigrants , in countless Amnesties to illegals - way before we took to the streets. Your uncles and aunts weren't the only ones who got GCs back then, they shared it with a majority of others who didn't even pass highschool!

    If you look at the current process, 50,000 GCs are given away in a lottery to any one who applies - no qualifications necessary ( so called "Diversity Visas"). A large number of GC applicants claim that they are too poor to pay the fees (asylees and refugees) and they get it gratis! Many get GCs for no reason other than their brother or sister is a US citizen ( in fact they out number us 3-to-1).

    Regarding taking to the steets , if Gandhi hadn't taken to the streets you'd still see 'Dogs and Indians not allowed' signs all over India. If MLK hadn't taken inspiration from Gandhi and taken to the streets in USA, there would still be openly 'Whites Only' places here. If Nelson Mandela hadn't been inspired by Gandhi and taken to the streets, there would still be Apartheid in South Africa. Taking to the streets doesn't make one "cheap".

    How do you say H1 person is unworthy, where as F1 is smart? A lot of smart F1s later transition into H1s smartly to continue here while waiting for their GCs. If your intent was to prove your "F1" smartness and superiority, you are not helping your cause, by making such ill-informed and frivolous statements!

    A visa (or lack of it) doesn't make a person worthy or unworthy. He/she needs to be a good human being first, who understands the sacrifices made by others.

    smartness + Good human being = worthy person

    smartness + asinine attitude = SmartAss

    I did not go to DC because i did not want to get the green card this way.I grew upwatching aunts,uncles coming from USA bearing gifts.I grew up watching cousins go for USA for higher studies.It used to be so special. Now its become so cheap. Now you guys have literally taken it to the streets. There's no difference between those illegal immigrants and us. This H1visa has ruined it for really smart students who come here on F1 with full scholarship.
    This software industry and these cheap bodyshopping companies made it nothing more than a whore business.
    My heart is broken. I dont care anymore.thats why i did not come to DC.

    There is no such thing in the Indian Constitution as the "national language." You can either read the document yourself or you can refer to the recent (late June 2010) judgment by the Gujarat High Court to this effect.

    There should be respect for all Indian languages. The more Indian languages you know, the more familiar you will become with India and Indian culture. Those who do not know Hindi need not rule it out from the list of other Indian languages they could learn. And the same can be said for any of Assamese, Marathi, Gujarati, Telugu, etc.

    Exactly...I was getting irriated when people are forcing and telling that I should learn hindi. isnt my personal choice...?

    Thank you everybody that has contributed. We need to raise $50,000 in the next 15 days. That is $3334 raised every day. Now even though this looks like a big amount to raise, with a collective effort we can do this. This is our chance to make this happen for ourselves. The alternative is just staying in limbo renewing EAD/AP every two years for atleast the next 10 years. That is an average cost of $800 every two years every member.
    We need 17 members everyday contributing $200 everyday or 34 members contributing $100 everyday for the next 15 days.

    Eb3 v/s Eb2 is a nonsensical nonproductive meaningless argument. If you actively participate in speaking with the lawmakers, you would know the bogus nature of this squabble. Each one of us has a choice. We can continue with this pissing contest or we could do something to fix the backlogs. We all understand the frustration and anxiety due to the long delays. It is easy to be drawn in meaningless eb2 v/s eb3 quarrel in the virtual world when one is not privy to how things work in the real world.

    If you feel compelled to engage in infra and trivia, please utilize your energy for your benefit by understanding the larger debate so that each one of us can employ our energy to fix our issues. Please use your energy in a positive manner. There is no point of this discussion. It is easy to write/post arguments just to support your own application/position in line. Anybody can do that. But such narrow minded approach will not help even a single soul on this planet, including yours. For those of you who want to continue with this bickering, you can do so at the expense of your own time. And when you engage in such arguments, please remember that whatever you all write or post about this nonsensical back-and-forth is not helping you or your family. But if you are sincere and care for this issue, if you truly care for your issue, then please consider participating actively to meet with the lawmakers to make our voices heard.

    Members who actively engage in the advocacy effort know when we are saying. For example � talk to nearly 125 IV members who lead the lobby day in DC during the past week. They will tell you the bogus nature of this Eb2 v/s Eb2. Stop wasting your energy arguing thing which have no meaning. Please utilize your energy in finding fix for the backlogs because there will never ever be a bill/set of provisions only for Eb3 or only for Eb2.

    Understood every point of yours & I stand by what you said except for the language as it could have been a bit better. Regarding EB3 or EB2, maybe IV should work attaching a provision as part of its CIR work, which makes USCIS determine whether a candidate is in EB3 or EB2 based on the PERM & 140 instead of letting companies & attorneys mention it. If this happens the process will be much better as USCIS controls the categories & applicants do not need to beg a company to throw them into an EB2 basket or EB3 basket. Also, applicants can have certain amount of freedom from the companies.

    When a process is flawed, there is always room for abuse. Of course, the abuse might be minimal, but when we see people with masters & 15 years of experience toiling in EB3 category it pains my heart. It is a fact there could be lesser qualified inidividuals who are in EB2 category, but the companies have managed to use these to hold the employees as hostage.

    Hopefully USCIS someday understands this and takes control of assigning applicants into categories than asking company & attorney to mention.

    Just sharing my two cents. Also, frustrations from EB3 should be tolerated by IV members, instead of beating them with "red dots". Because if we request members to put their time and effort then it would be mostly EB3 members as they are the "worst" affected. I am sure every year between july-sept most of EB2 members will do bulletin-watching & there is nothing wrong in it.

    Alias, very helpful guidance. I plan to take this up with my attorney and see if I can correct the error. Can you let me know which attorney firm worked for you? It feels frustrating that now I need to spend money on an attorney and go through all the stress for correcting the mistake probably made by a USCIS staff.
    To the question from urwelcome, I don't think I received a I-485 approval notice. As far as I know, I had the biometrics, then an RFE and then a Welcome Notice in January. I have never received the actual card as in the case of Alias and my spouse's status remains unchanged. I am on EB3 (India) and the PD is August 2003.( don't have the exact date on top of my mind, it has been a long time:-))

    Berry Scheniderman, Virginia. Horrible experience. They took 3 months to file for my H1B extension and then I was running out of time so I had to get it converted to premium processing. They simply sit on the case.

    Alan Heckler, (Specially the paralegal named Cathy)., takes months to respond . The only thing they are quick are at getting money. Totally unresponsive.

    Under current, LLC in Chicago , takes weeks to see the paperwork that you send and weeks to process them

    Due to family constrains I might be taking some breaks in future which I think I can do with EAD(but not sure :confused:) and on pending I-485 ( I am the dependent of the Primary applicant of the GC).

    On H1 I know for sure I cannot take this break for even 3 months without pay stubs. So I was working hard without breaks on H1.

    But once I am on EAD status Am I allowed to take breaks between the contract jobs.

    So My question is... Can a dependent of a primary applicant on an EAD, AOS pending status allowed to take breaks between jobs?

    why didnt ur friend apply for MBA in canada?....i think a lot of people have misconceptions and pre-conceived notions about canada.......they think of US as the best and canada does not even figure in their list of options......i have got fooled once into h1b to US unaware of the broken immigration system.......wont happen again......i believe the ones in US on h1b visa from india should spread the word about the pathetic EB 2/EB3 india scenario so that no one else gets lured into US by h1b candy

    Yes it was his first lesson. Yes US is good but not for EB2-I/EB3-I. I was also fooled when I came for my MS before. Not anymore.

    Not sure what you mean by this...

    I never said I agreed with country base quotas for EB. However; lawmakers, etc. are not stupid people. We have to try to understand why they are there and why it is not being changed. We have to understand the symptoms before you can find the cure.

    Your argument is that the country quotas help limit nepotism and discrimination based on national origin. However, this is already prohibited under DOL rules if you look at form ETA-750A. Therefore, if this is happening, it means there is a failure in the labor certification system to prevent this type of discrimination. Also, nepotism is not all bad as the Clintons and Bushes have been demonstrating :D.

    The country quota owes its origin and sustenance to deep national insecurities around race. It will change eventually as the makeup of the nation changes over time. In the short term we will see movement as the UK bumps up against the 7% limit.

    My company went through a 10% workforce reduction company-wide just when my PERM application was ready to be filed. Although nobody from my group has been affected, 2 people with the same job title from a different group in the same office were affected. Their job descriptions are entirely different. I have about a year and a half before my H1B expires. I would appreciate anybody answering the following questions I have:

    1. In Form 9089, should the answer to Item 26 be 'No' since nobody in my group or area of expertise was affected?

    2. If the answer to Item 26 should be 'Yes', is it sufficient to notify and consider the people laid off? I am confident that they will not qualify for the position. How long should this 'notification and interview' period typically be?

    3. I have heard that my company can be sent an audit notice. In such a case, is it sufficent to justify that the area of expertise is different. What is the success rate for this?

    4. If the audit response is rejected, what happens then? I have been told that the employee will have to return to his home country immediately and cannot refile his PERM application.

    During my career, I have investigated opportunities to work in a few other countries and have consistently found that they had significant barriers to a US citizen coming into the country to "take jobs from their citizens". While I might have enjoyed working, for instance, in the UK or Australia, I also accepted that their governments had the right to set their own "house rules". I guess, though, it may be too much to ask to expect similar consideration for the US government's right to set _its_ own "house rules," no matter how quirky they may seem to others.

    As for the comparison of which visa holders' spouses/dependents can or cannot work here, I would ask the unasked question, "Why not allign these variances in the visas in the OTHER direction?" (I.e., why not simply change things so that NO spouse or dependent who obtained their visa based upon a primary visa holder is permitted a work-visa?) I realize this is probably not a popular position in this forum but, if for no other reason than being the "Devil's Advocate", perhaps it should be raised and considered. :)

    never worked for "employer x" after H1 transfer, perhaps you are out of status. What is your lawyer saying? You never transferred H1 back to emplyer#2?

    I have maintained valid status with my current employer (Employer #2). Employer #2 sponsored H1B was valid until 2008, then I used EAD. I have always maintained valid status. My only concern is I never worked for 'Employer X'.

    Would you still see this as an issue...?

    Thank you. You seem like a rational person who is balanced in arguments. I can give you real life examples too. Let me start with that. In 2005 I and my friend from a non-retrogressed country graduated with a masters, same degree same specialization.


    * In a few weeks, all the 20 in the retrogressed country find opportunities among dozens of giant offshoring firms that quickly send them on H1 or L1 projects, within months or may be a year they are settled in the US and at most in 2003 their greencard process is up and running


    Now THAT is over-generalization. You think all of us Indians and Chinese get jobs as soon as we graduate in giant offshoring cos? My friend you're stereotyping. It is wrong to assume that we get our jobs because of our nationality and not our skills.

    Anyway, continuing with my example. My friend and I both found jobs after a few months of struggle in small boutique consulting companies (run by Americans), mind you no offshoring. In fact my friend's sponsor is Indian, my sponsor is American!



    * The 20 equally qualified non-retrogressed however linger in their homeland for years and duke it out till the brightest 3 manage to find a rare opportunity that only comes every several years.. those 3 finally come to the US in 2005 and may be start their gc in 2006


    Very subjective. My own example, none of my fellow-graduates were in the plight.


    * Turns out (or actually it was known all along to people before they chose to came) that the US only gives 5 greencards per year and because they know qualified people exist in all countries and they don't want few countries to swallow the whole quota alone, they give 2/5 to non retrogressed and 3/5 to retrogressed.. only then do some people remember to cry not fair, well it wasn't fair to start with!

    I agree a universal 7% limit for any coutry regardless of its population and number of college graduates is stupid.. the percentages need to be adjusted. But to tell me that the 3 unretrogressed have to stand at the end of the line behind the equally qualified 20 retrogressed who came here faster (and chose to come here knowing their homeland is retrogressed) that is really fair.. yeah right!

    Yup. Standing your turn in line is fair. And that's what needs to change. EB visas are about skills and not nationality.

    You need to quit stereotyping and being unfair to us by saying we get jobs because of our nationalities. Brother, you don't get degrees or jobs because you're Indian or Chinese, but because you add value.

    That 2% could be an extremely conservative estimate for 2001-2002 filers. Why ? Many filers are already been approved. The only filers that are left are probably who got their LCs between 2004-2008 with priority date in 2001/2002 and labor substitutes .(note in 2005, the PD of EB3I did come all the way to June 02). Most of left outs have filed their 485 in June 07 already and you could probably see a huge percentage in too, because by then people knew about the website and started tracking.

    I hope you are correct but look at for EB3-I.
    There are about 14 pages of EB3-I before 2004. So with assumptions of 2% applicants registered on there will be approximately 30000 to 35000 EB3-I applicants.
    (14*50)/(0.02) = 35000

    I'm a South Indian and I have never had issues with Hindi or Hindi-speaking people. In fact, many of my friends are Hindi-speaking and I'm quite well-versed with the language as well (why not?). You cannot make a blanket statement saying that everyone speaking a particular language is rude or has bad attitude. Just goes to show one's ignorance.

    Just look around and see what's keeping this country together? You can move from NY to LA without having to think twice. Try doing that back home ;)
