My PD is Dec 2006. I got my EAD 15 days ago and the card is valid for 2 yrs. So the guy that approved my card doesn't believe Dec 2006 is a possibility this year!

This is for the ones who think that the discrimination based on EB3 or Eb2 is a bigger issue! I would not get into the discussion on why I think that IV is not just about EB2. Also, on our forums it's about reality and not empathy, which everyone should understand.
Now having said that, please direct your energy towards elimination of country limits rather than fighting a fight which was in your past. Why your company put you in EB3 and not EB2 is not something USCIS or US can control anyways. But when you are EB2 or EB3 with same qualification, experience and expertise compared to someone from say Europe, Australia and many other countries but China, India, Mexico and Philippines than why should that other person get it before you do when you applied before him???? What is America getting anything different from this other person?
Now talking about diversity for country limits India is more diverse than any other country in the world! And hey, most of them are already here in the country and waiting in queue, how is this helping the diversity?

Could you please translate this into layman's English? What you appear to be saying is that speed (CIS efficiency) is more important than number (quotas), but your expample confirms that cases are stuck because of number unavailability (quotas), not because of CIS inefficiency. You got your own green card in three months, did not you? That tells me that CIS darn well capable of processing applications in a timely manner.
Like I said, its a combination of the 2 main things, the efficiency of processing and the quota limits. Changing either 1 without the other other probably won't get us far.
Yes, USCIS IS capable of processing quickly (for example, my own case - but I'd say I was very VERY lucky, rather than an indication of system wide improvements). Remember, my GC was approved whilst my PD was not current, and I am still baffled why this happened. Having talked to many people about it, there is a strong suspicion of "squeaky wheel" helping.
What I was trying to say was - the perceived improvement in speed in the last quota 1/4 of this year (May- Sept) was NOT because USCIS suddenly streamlined and improved their processing speed. It was because there was a backlog of approved applications just waiting for PDs to move so that visa numbers can be assigned.

The real reason people are treated badly at Indian Consulate is because there are Indians working there!!! Every where you go, the first thing an India sees is the skin color. I went to Atlanta to a sweet shop run by some Indians, there my 4 year old saw the water dispenser and asked for water, they had some use and throw paper cups and a steel cup tied to the water cooler (just like in India). I took the paper cup, suddenly the guy came running down and started cursing that I am wasting the paper cup? I asked who the paper cups are for. The answer comes as others. This is not a one off incident, be it Air India, Temple, Restaurants, its the same thing. Indians have such an inferiority complex and they are just freaking jealous of every other country man.
On the other hand, Indians have 0 people skills and have no clue how to act on a public place or do they have any concern for others. I took my son for Kumon yesterday. As in any Kumon, majority is Indians, the hot topics yesterday was politics, dinner and how work sucks. They were discussing this so loud inside the establishment. Kids were trying to work and there they were arguing, laughing, its just pathetic.
So, what I am trying to say is, if you are trying to take this fight with Indian Consulate, is it really a one off thing..

If they are going to work in US, then consulates will ask "super technical" questions at the H4s, like "Who will be your client?, Show us the contract!" etc.
May be the reason is not to scare the H4s right after their marriage.

I think it is very important that all those seeking to file a case against the DOL review the Liberty v Chao ruling (https://ecf.dcd.uscourts.gov/cgi-bin/show_public_doc?2004cv0915-41). It will be very difficult to file and win a case prior to September 2007 unless one files a case in a different federal circuit. Note that the 485 and DOL cases were in the DC circuit which lawyer Rajiv has been cited as noting are averse to decisions against the executive branch of government.
I quote from an ILW analysis (http://www.ilw.com/immigdaily/digest/2005,1011.shtm) (I believe I had posted this elsewhere):
However, the plaintiffs in this case have made it somewhat easier for future litigants similarly situated in that DOL has provided the District Court with a projected timeline for adjudicating the massive DOL backlog, the failure to do which may make future courts more sympathetic (see p. 16). This case also provides a helpful list of cases arguably on point which other district courts in other circuits may find more persuasive than those cited by the District Court in justifying its decision (see p. 15).

This is in response to vldrao's and delax's calculations...
Are you people 'creating' new quota rules?? what is this 7% with regards to any category? 7% is the per country limit including all categories. EB1, EB2, and EB3 gets 28.6% each, out of the total available 140,000. This means each country will get 2802 visas for each of these three categories. However spillover can be redistributed to lower categories and to oversubscribed countries.

Did anyone research whether it is possible to get some relief through rulemaking, instead of legislation? For example, there is no 'explicit' prohibition against issuing employment authorization to spouses of H1bi employees. The rule-making agency (in this case the DHS or USCIS) can grant a benefit that spouses be provided with employment authorization. Recently, the USCIS actually did provide regulatory relief by de-coupling the H1bi period of stay from the period of stay in H4 status. An idea to consider...

I think it is very simple to understand. It clearly says it's free for people who filed their adjust of status application (I-485) under new file structure. Since we(most of us) filed under old file structure, we'll always be paying $340. Point numbers no. 5. is about AOS application and not about EAD appl.
Yes , its Free :D Anyway - lets talk with a 3rd person (maybe USCIS) and confirm. Its Free, if you read the EAD forms its clearly written that once some one pays $340 ( not other amount) it becomes FREE for ever. I just checked the EAD forms again before writing this post - let me PASTE from EAD forms if that clear the confusion.
Renewal EAD: If this is a renewal application and you
applying under one of the following categories, a filing fee
not required:
1. (a)(8) Citizen of Micronesia, Marshall Islands, or Palau;
3. (a)(11) Deferred Enforced Departure; or
2. (a)(10) Granted Withholding of Deportation;
4. (c)(l), (c)(4), or (c)(7) Dependent of certain foreign government, international organization, or NATO personnel;
5. (c)(9) or (c)(16) adjustment applicant who filed for adjustment under the fee structure implemented July 30, 2007.

Are you kidding me? You are recommending http://www.usabal.com/ aka Berry, Appleman & Leiden LLP? DO NOT USE THIS LAW FIRM. RUN AWAY FROM IT AS FAST AS YOU CAN. They totally screwed up my case. My PD became current on June. I asked them repeadtly to file my 485. And I asked them for like 1 1/2 month. But they waited till July to file my case. So, I was affected by this visa fiasco. Their lawyer do not answer phone calls, they don't return voic mail and they do not response to email for 3-4 days. It is a totally BS firm. If possible go with small immigration law firm.
I agree. My case was approved online in early June, I kept asking them if they received papers from BEC, and they would not even take the time to check. As a result, I was unable to file in June even with a current PD. I ended up filing in July.

Planning to call my friends and relatives (US Citizens) and ask them to make the calls.
