It looks like some lawyers maybe posting messages about their law firm here and advertising here, or asking their clients to advertise about them on the forum and get discount. So I guess we should only trust senior member postings and trust the postings where people talk about bad lawyers

This is in response to the poster indicating that H1B cap includes h4 time. This was changed in the 2005 interim AC21 memo which decouples h1b and h4 visa status durations. H1 Time does not include time spent on H4. Anyone on h4 can always get a new h1b term for 6 years.

The Australian laws are very clean and straight forward. There is only one application form with some very simple question and detailed instructions. Just fill up the form, enclose the necessary documents and fees. That's it. You are done. In due time they will let you know "YES" or "NO".
There is no need to feed fat-belly hungry sharks called "Immigration Attorneys" (of course there are exceptions).
Once your case is approved, you and your family are eligible for the all the rights (except Vioting Power) enjoyed by any Australian Citizen.
Once accepted, there is no official discrimination.
Here the US Government cries about anti-discrimination, human rights etc, but those are only eye-wash. They should take lessons from the Australians.

H1B is the question. But yes I also started with 50k but I am moving up. IT salaries are higher. I know banks paying 70K and going even more above 80K. You can also work as independent contractor type unlike H1B. No middle men inbetween and all expenses before tax.
Yes ofcourse US is a far bigger economy. But I was born in India, what can I do. Within my contraints I am looking for best possibility.

You should definiately look for US options.

Don't you guys think there is no spark anymore in IV? Have you heard anything incourging from IV lately? Where is QGC or whatever there name is? Where is money?

The updates are provided periodically on forums from IV core. We are currently working on the House side for pushing SKIL forward. There are a few things missing in SKIL bill that we would like to get introduced. Mainly its the 3-year extensions of EAD and AP and 3- year ext of H1 for labor applicants that is missing.
We are also trying to assess of SKIL in house is gonig to go forward, and in the event it doesnt, what other bills can be vehicles for putting our provisions like the S 1932 style.
We try not to restrict free voice and opinion from members on forums however, if it gets downright nasty we will edit posts and censor. But in principle we try to avoid it as much as possible.
If you have questions, and if you think that IV core is not up to the job and needs help or needs to pace up, or if you think you have questions for IV core, please pick up the phone and call the 281 number listed on the website's "Contact Us" and call us. We will answer ALL your questions as to what we are doing.
That would be much more productive way of finding answers to your questions.

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.

Simple and yet we have not acted purposefully. I have a strong feeling that this visa grab is still going on. HLG has sent out another immigration alert to all registered emails, similar to one posted on Feb 9, 2007. . And I quote a bit

We protest such a biased action. We had tried to reach many members of the house and senate and presented the above issue to them. Still our issues have not been resolved. We demand relief at equal footing. Do not appropriate all unused visas to one single category of affected workers.
Next one/two days are crucial. Let's make a difference.
Note:
1) In the above, I am trying to be focused, addressing one issue at a time. Backlogs, Slowness, Finger Prints are also other genuine issues. Let us stop the greedy stealing by HLG and their ilk.
2) If for whatever reason IV will not come up with a web fax, a few of us must act individually and let the congressmen and senators know of our protest. I had faxed to a few Congressmen and Senators, from the fax machine at my workplace. Believe me, these types of protests have worked in the past.

I am actually curious about peoples reasoning behind not attending the rally. I don't think anyone should judge people's decisions, but if we can understand why we didn't succeed in tempting you to come, we can learn for next time.
It sounds like you might be considering going to another county or back home? Ironically, if this is true, it highlights perfectly what one of our key messages was at the rally.
You are a poster child of reverse brain drain. The US needs to keep talent, whether it is home grown or imported. By making the process so grueling, people are starting to leave in droves.

I am a healthcare professional on an H-1B because I am not a nurse nor a PT so I don't fit into that elite Schedule A Club! Ironically, there is a far greater shortage of professionals in my field than in nursing (PT's are still in high demand), but I don't qualify for Schedule A so I'm stuck between two worlds. To be quite honest, I'd rather be stuck in limbo with you guys than to be grouped with them any way! Keep hoping, keep smiling and something good will happen!

what makes you think people participate in those? from personal experience
in the MN chapter, it's hard to even get replies to e mails, forget meetings etc. of late though i'm glad to say the MN chapter has really beugun to pick up again.
ask the tri state guys how much effort they put locally- meetings- fliers- phone calls, all by a handful of volunteers. so all this is good in theory and yes it takes time. but the apathy (even hostility) that was encountered was frightening. ask chanduv23 someday what the tri state guys went through...

To me the long wait and inaction of government to do something about it is human rights violation.
A person works for 10 or more years in this country and is bound by it's employer's wish for such a long period of time is a human rights violation.
Government may create laws but it is also a responsibility of government to provide remedy to a problem caused by the law.
It's a clear indication that US government don't care about the long delays. The only solution to this is change in quota law for EB category or some special executive decision to end the delays. We must STRONGLY PROTEST GOVERNMENT'S INACTION. Should that be a court action or a public demonstration. I will contribute to both the actions.
So my question to you all, can we take action on the basis of Human Rights Violation or Indirect Slavery?

What does the introduction of SKIL bill in House mean to us? i.e. what are the likely scenarios from here on? Thanks in advance.
It seems tough to have this being passed unless CIR dies. Only 10 weeks are left for any bill to be debated and passed by both houses. In my opinion it is very difficult. I would personally wait to hear opinion about this bill by legal experts and media. It is too early to speculate on its failure or success.
btw. If Uma Thurman endorses this Skil Bill it will definitely get passed!!

Well, I've got a few reasons.
1. I don't like the attitude that comes along with the people that speak it.
2. I just don't like the language.
3. I don't live anywhere close to a place where I must know Hindi to survive.
4. The Indian Constitution recognises English as a subsidiary official language.
5. If I have survived as long as I have without knowing Hindi, I'm sure I can survive without knowing Hindi for the rest of my life.

Its sad to see even the newer generations following the footsteps of their parents.

I think that going back to your home country ONLY because you feel overwhelmed by the delays in GC processing/retrogerssion (assuming you are quite content in your job and standard of living) is not a good idea. Especially true in the event that you and your family experience difficulties in adjusting professionally and socially after returning back. Chances are you might soon get a feeling of having taken a wrong decision in the heat of the moment, especially if the guys who stay back and ride this retrogression storm see some relief while you are still trying to adjust to the changed environment of your home country. You may even get tempted to come back and give the GC thing another shot but then you have to start at square one again.
Going back to home country only because of the shortcomings of GC process is like deciding to take a sanyas because you are tired of dealing with social issues. I belive a decision to renounce something should only come from a position of strength. A true jogi is one who understands the triviality of society and decides to rise above it...not the one who denouces it because he can't deal with it.
As the saying goes..its darkest before the dawn...I truely hope this is the case for all of us here...

expertise are..... mind you there are not that many jobs available. Now people will argue this isn't the case..... but I have seen many many people just hanging around doing Gas station, security, truck driver jobs to get to citizenship and then come back to US.... Beware....
