Nice idea but does anyone honestly think the DOL cares. I am somewhat fortunate that my 2002 labor finally got approved in the middle of 2006. My son is not so lucky since he turned 21 while I was waiting. When my senators office took the matter of my son aging out up with the DOL I was told to put him on an F1 visa and send him to college so he can REMAIN (he wants to LIVE here, big difference) in the United States. These people do NOT care what they are doing to your lives. They do not care that my son has NO path to permanent residency any more and that I have to write the enormous check for his tuition twice each year so that I can still have him in the same country as me and his father. I feel awful for anyone still waiting for their labor certification but at least you will eventually get in line for your green card and will get ahead of those filing now with much later priority dates. You are indeed victims but I just wanted to point out that there are thousands of young adult children who have had their hopes for getting a green card totally shattered by this backlog center fiasco.

Anyone falling into his trap and fighting on the thread ?

When I mean attitude of the people that speak it, I mean the attitude of those that speak it to me after I have politely mentioned in English that I do not know the language and yet those morons begin a lecture that I have to know the language because I am a citizen of the nation and it doesn't matter where I live. The constitution of India does not state that every citizen of India must know Hindi nor does it state that no matter where in the world an Indian lives, he must know Hindi to be an Indian citizen.
At the end of the day, no matter what anyone says or thinks of me, I still don't have one good reason to learn Hindi! Yet, I am a Proud Citizen of Indian and there is nothing that people like hpandey or ameryki can do about it! This is the truth and so will it remain!

Its only going to take 5 people to break away from the 64. Those 35 "No" votes are the ones who want CIR dead NOW. They are not going to change. But those 64, its only going to take 5 people to walk away.
There are 24 amendments. I think atleast 5 people would see their amendments fail on the floor of the house and probably another 5 atleast who would withdraw support because someone else's amendment passed. This baby is going DOWWWNNN this weekend per my estimate. I could be wrong but again, 24 amendments ? That's too many darts on a fragile compromise.
as far as i know Reid is smart about this thats why hes using the "clay pigeon" manuevre where all the 24 amendments would be tied as one amendment and then voted to pass on, once its passed then the cloture vote will come in (without the individual amdts yet voted on) once the cloture vote is secured then they will have 30 hours to vote all the individual 24 amdts after whc a simple majority vote ( min 51 votes) wud be needed to clear the bill...real smart

We are not talking about what's beneficial to the United States. What we are discussing is what the law says. It doesn't matter if it is beneficial to the United States or not, if it is the law of the land then everyone has to abide by it; even the government. I think everyone has a different opinion on what's beneficial for this country. If you talk to the people at numbersusa.com, they will say that H1B program and employment based immigration is the worst thing that happened to this country and should be stopped right at this moment yet we think that this is the best thing for this country. Go figure.
By the way, you seem to suggest that everyone in ROW is unskilled professional. Nothing can be further from the truth. I don't know where you get your facts from but it sounds like you certainly need some help on that front.
It does make sense that the overflow numbers are given to higher preference categories in single state oversubscribed countries. When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher

I did not say all of the dems, by same token not all republicans support immigration (legal or otherwise).
What I am saying is that generally, republicans have (even if it is to spite the efforts of people pushing illegal immigration) been more supportive of legal than illegal immigration.
While many democrats have been supportive, the one of the main reasons for the delay are the dems themselves, their crappy CHC, who dont want to allow any immigration bill till the illegals are elevated on the pedestal. The Dem leadership have put the immigration issue a hostage to the whims of CHC.

I may not need to tell you this but you are dealing with most greedy, money making machine in US govt. System. This organization churned out 200K EAD last year in 1 week, just so that they don't have to issue 2 years EADs. This org. is rejecting I-485 to get $1000 MTR fees, they will not spare any chance to take money from your pocket. I would say Instead of asking them for the fee waiver and wait 3 months for their 'NO', just give them the 5K and move on...

Apr VB EB2 is U and EB3 is doing well every one is normal exactly like every other VB no surge of threads and replies everything is normal
July VB Eb2 is in Apr 2004 and Eb3 is in U again every thing is normal
Aug VB Now suddenly Eb2 is 2006 and Eb3 is U ( no change) and all of a sudden there is a flood of e-mails complaining injustice against EB3. I think the timing of when Eb3 folks realized injuistice is what ticked off many.
I am not saying every one shares this feeling but just the sheer volumes of posting on this thread speaks for itself. I am sure many do not agree with me (or least pretent not to agree) Any one can query Eb3 injuistice posting before Aug VB and compare it since this bulletin was posted and see the data speaks for itself we do not need any body to prove anything

I was 100% determined in the beginning to attend the rally, but could not for the following reasons.
1> I was in Dallas and family in SoCal for last 9 months(from Dec 2006 to be precise). I used to meet my family every other weekend. Was trying very hard to find a project in Socal, and finally I got one where joining date was Spet 13th. I could not dare to ask for leave in the very first week. To tell you the truth it took so long b'cos of H1 status, everybody wants me to transfer my H1 or they are looking only for GC/EAD holders. Hoping to get EAD soon.
2> My husband was planning to attend but somewhere in Aug last week we got FP notices and date is Sept 18th. The FP letter clearly mentioned that postponing might cause delays so we decided that he also has to drop the idea.
Of course we contributed towards the rally.
I am very proud to be part of such excellent grass root organization and now since I am in Irvine I can be active in Socal chapter.
Also we are eager to join in the next rally and have total faith in IV leadership.

2. I just don't like the language.
3. I don't live anywhere close to a place where I must know Hindi to survive.
4. The Indian Constitution recognises English as a subsidiary official language.
5. If I have survived as long as I have without knowing Hindi, I'm sure I can survive without knowing Hindi for the rest of my life.

My law firm, Greenberg Traurig has been good too. Their immigration practice worked extremely hard to get the applications in-flight on Saturday. May be bcose they did not have 1000s of cases like other immigration law firms.

Just a simple question. Corporations are arguing that every year 100k new jobs are created in high tech. Even 75% of the new jobs are for H1b then only 75k H1bs are needed. Even if you include other jobs teacher,Healthcare you do not need more than 120K every year Why do you need unlimited H1bs? Any pro immigrant lobbying group is not giving justification in numbers though everyone accepts there should be increase in H1b numbers.There should be increase in GC numbers as backlog had increased(But in this case also no one gave correct numbers based on requirement) but nothing wrong in H1b quota and some regulations in H1b to minimise abuse.
Another aspect is in the bill they gave 115k H1b for 2008. If they do not put restrictions your company cannot get any new H1b as most of H1b quota will be used by Indian consulting companies in one day. Do you think it is correct?
If not correct what is your solution? Corporation solution for this problem is unlimited H1bs by giving exemption to STEM and US master degree holders from H1b quota.
I am also opposing the restrictions in H1b program in the bill. But I do not have any alternative solution for the problems in the H1b program.
Again, there is a common misconception that companies have unlimited access to talent in other countries, and the only limiting factor is the quota of H1B visas.

Can anyone guess where is the biggest talent pool? Nope, not in Bangalore, its right here in USA!! Not all companies are looking for the cheapest person. They are looking for the best person. And in many cases, the best person is already here, and has gathered more experience over the years working for US companies. But they cannot hire her, simply because she is on a visa and thereby beholden to another company. If she had a GC, that would free up the talent pool and thereby make many companies less reliant on H1Bs. Increasing GCs for EB candidates has the same effect as increasing H1 quota, with the added benefit of making the cream of the crop available and reducing the uncertainty and hassle of hiring an H1.
This is why it is in the best interest of companies to support EB GCs.
My friend Senthil makes the same mistakes (repeatedly, unfortunately):
(A) Assuming that "good" companies will not be affected by any change of increase in fees for H1B, since they presumably have unlimited pockets and unlimited access to unlimited talent. (Big ha!ha!)

Are we/employees really supposed to know all the steps involved in the approval of GC process (Perm, 140/EAD/485 etc.)?
I work for one of the fortune 100 companies, to my surprise, none of my European colleagues is aware of all the GC process. All they do is just provide documents what ever the HR department asks for. They don�t pay from their pocket for GC (ideally correct). None of them has clue about priority date etc�.they get communicated by the HR department about their GC process.
So putting your case in perspective. I am assuming that the HR department would just hand over the GC to the employee. Neither the HR (I think) nor the employee (definitely) would worry about the PD being current.
Ideally if a law firm is point of contact for a petition, what would they do? Would they go back to USCIS and tell them that the GC is approved by mistake? I don�t think so but some one can confirm if they had experience otherwise.
I highly doubt the HR dept of an organization is filing labor certs, I-140s and I-485s without the assistance of immigration attorneys whether in-house or outside counsel. I work for one of the largest hospital chains n the US, and our HR offices use external counsel for immigration matters.
