What freedom and justice you are talking about? The folks on this forum are not responsible for you misery. So stop venting you frustation here. Though, I sympathize with you situtation but unfortuantely the whole legal system is unfair.
What we have done here is a good start, soon we will lobby for passing of SKIL bill . And the day is not far when you too will be benefitted by these efforts

I did sometime back.
Given thanksgiving is barely a week away, we can be certain of the usual platitudes directed at immigrants - this is a good time to remind the average American how far they have strayed from their roots and forgotten the true sentiment behind the tradition. Immigrants have always been hated and reviled by those that got here earlier - but the current anti-immigrant sentiment is vastly different in scale and sophistry due to the times we live in. If every IV member signs up 10 citizens to the immigrant cause, we should easily be 100,000 strong in a couple of weeks. It could be anyone from your advisor at school who mentored you to your buddies at work - even the stinkin relatives should be harassed. Though CIS and Numbersusa pretend that they are a product of the current anti-illegal sentiment, they started out much before the so-called 'wave' started. And they have adapted and honed their strategies very well to crush whatever relief Congress contemplates/passes. Consider the way CIS was initially dedicated to 'researching' immigrant issues that they would complain about the media's positive stories about immigrant contributions as merely anecdotal evidence not worthy of rebuttal. Now they are suddenly fond of anecdotal evidence themselves since experts began demolishing their claims of job-stealing and other baseless charges convincingly(esp CFR's Sebastian Mallaby) using empirical evidence-they shamelessly stoop to use someone's sob story to make their case. So, as repugnant as their motives are, they are too transparent for their own good- and they can't cover their tracks -which is good for us since we are appealing to the fair minded. Remember - every one in the US is an immigrant or an offspring of one. They have always been hated and reviled -so if someone who benefited from the immigrant tradition of this nation wants to turn around and deny it to those following him/her even though their ancestors did the same thing at a great emotional/economic cost to the then existing natives- they have a higher bar in explaining why the current bunch shouldn't continue to benefit from the great tradition-merely being bigoted but sophisticated enough to hide it isn't enough. so don't lose heart but dont sit on your ass either.

I have a my my case in pending state for H1B transfer from company A to company B.
Pending status h1b with company B.
From Company A : I got the Labor and I140 Approved.
I m trying to file my 485 through comapany A- But my employer says that I need to have new H1B with him- Cos his company merged with another another company.
Can someone try to help me on it:(

It all depends on the number of people on EB3 for each month from Nov 2001 to date. Since dont have the slightest idea, there is little we can do. if you can switch, go ahead and switch. Its no use speculating, data doesnt tell anything because sample size on that site is very small and the data is not up to date.
if an EB 3 switches to EB 2 is the visa deducted from the EB 2 quota or EB3 or both, i guess it should be EB2 ... considering USCIS..who knows.

What Logiclife means here is that this amendment will fail to have enough support as it contains a provision for MORE H1-B's.
Got it. Though, it exempts everyone with MS from H1B quota, there should be emplyment opening for all. Employer should sponser with $5000 filing fee. They can make 1 million H1B visas with 10,000 fee. But who will sponser?
This is true too numarically exempted folks in EB2 and EB1 catagories.
I remember that there are so many H1B visas were not used, when H1B visas are having a limit of 195,000.

I dealt with Fragomen for last 7 years. I can say following about my experience �
I work for fortune 500 company and Fragomen was the law firm my company used until early 2007.
1> The emails, voice mails I sent to them used to disappear in a �black hole�. I had to wonder whether and when any response will come to an urgent, time sensitive question.
2> Many times after waiting a week or so for response I had to escalate the matter to my company�s legal department to talk to Fragomen. This used to work like charm, I used to get answers within hours.
3> I had to keep them reminding them about next step to take, as delay from their part had cost me years in the processing.
4> I think many of my co workers had similar experience and that is why my company finally switched to different law firm in Jan 07.
5> I hoped to never to deal with them again but �last week I got invoice from Fragomen for something the did for my case in Jan 2006! I don�t know why they sent it so late and why directly to me instead of my company. Well, this time I am going to wait until they call me to take any action on that invoice.
So they lost a Fortune 500 client because of their customer service and I think they will continue to loose more if they don�t change.I hope somebody from Fragomen reads this and fixes their system. To me I am very glad that my company left Fragomen !

I would expect a minimal level of service from an expensive lawyer whether my company or my wife's company or I myself pay for it. We are their client. That is what they do not understand.
Can you believe they took 10 days to inform us what docs we need to provide for the 485 filing even after the fact that we had called them the day in June when the priority dates became current. Even in the list of documents, they had "Certified Birth Certificate" and when we asked how do we get Certified, they were like oh just give a photocopy. We had already spent 3 days researching about this CERTIFIED BIRTH CERT. The certified concept is something which is not common in India but it is in USA and a company like Fragomen should know this - it is their job.
Even after HR's multiple emails approving to start the filing 15 days later they ask us if HR has approved this - RIDICULOUS.
We asked them for the copies of the filed petition, they took 1 month to provide them as they were TOO busy filing other applicants - fine but making copies and sending over should not take more than 20 mins.
Now, I have been asking for a receipt for the money I paid out of my pocket so that I can get it reimbursed from my employer, they are giving me a hard time.
All I expect is when we are paying so much money - they should provide services to us.
All I know is if I was providing this level of service to my client, I would have been fired, but given that in this process you get stuck with a lawyer and cannot do much about it....they are using it to their advantage which they should not be...

We have the EAD until Oct 2008 and we still didn't file for the renewal, I am still on

Guys, any idea on what happens to GC Process and H1 in case your employer is acquired by another company willing to do similar job.
My company sold my business unit to another company. I filed my 485 3 weeks ago. I'm on my 7th year H1 which is already extended to Nov 2008.
Both companies are willing to cooperate.
