There are similar things happened with USCIS and they got strong and angry reply from congress in the past. That is why we collectively need to contact congress...I wonder why IV is not forth forward in this effort from the gecko???

To pbojja, your post shows how you may have completely misconstrued my post. I haven't written the post out of frustration of not being EB-1/2 at all. And am I dreaming when I hear you say that good English speaking skills aren't important in the U.S? Maybe I am in another world. I said clearly that the 'fraud' desi firms and their employees have tarnished India's image. They should be removed from the system and we should be in line with 'genuine' cases. What's wrong with that? Where's the unfairness here?

There can be 100s of bugs in the system, but this is not the time to cleanup.

Yep. My impression is that IEEE USA is anti H1b, but it supports EB visa. For those who rail against desi consulting firms, IEEE USA is the friend, not the foe.
On the surface, yes, IEEE-USA supports EB visas and opposes H1-B visas. But if you take a closer look, its not as clear cut as that. What they really want is to restrict immigration to the most exceptional foreign scientists and engineers (roughly those who would qualify for EB1), and make the path to a GC faster for them. They are dead opposed to foreigners being hired for general engineering jobs, and the current practise of almost everyone on an H1-B being eligible to apply for a GC. I would think twice before calling them a friend to any of us; they are at best anti free-trade restrictionists minus the rabidity and political incorrectness of our "friends". I agree its a great idea, still most of crowd don't understand what are we asking and relates us to un-documented workers.
Even within legal community most people who are pre-gc stage (H1/LE Etc) they don't have any interest; ppl came to me at work after rally to tell me that they are 4-5 years away from my situation so they didn't feel attending rally. Bigger the better, we need big crowd, NJ/NY/MD/DC/VA are worthless. We can try doing rally in Houston, TX area, we may find dedicated people there. But I feel it will be very tough to show heads rally in big numbers.

I have been thinking about whether to attend the rally or not from past few weeks. Attending the rally would require me to take a day off. Finally today without thinking twice I just went to my manager asked if I can take day off on 9/18 instead compensate the work in the following saturday. It was approved and I am attending the rally on 9/18!
I am feeling so good now.
Also, I live in DC area and can help if somebody needs to be picked from airport to the rally and drop them back if needed.
Hope to see thousands on 9/18th...

First off it is quite frustrating with people not participating and not putting their money where their mouth is. However, on a constructive note, screaming at people for behaving the way they are behaving rarely gets them to meekly surrender and start doing the right thing. Whether people do it out of their own free will or after persuasion, it take courage for people to participate. What works is to look at the problem and not to personalize the issue. So poor participation is the issue. If you are consistently not getting enough people to attend then it makes sense to delay the frequency of the meetings as one option. The other option is to call people and ask why they were unable to attend and give them a chance to come for the next meeting. Maybe the projection of rounding up x people was based on poor assumptions. So setting realistic expectations and then building momentum from there is the key. This is a dry tough fight. We need to set up tangible goals which break the vision down yet show the grassroot level people how the baby steps will lead to success. Most people in my opinion, back off because they do not see a realistic connection between the baby steps and the final vision. I think if we treat this like a challenge and try to understand the underlying problems, this movement will have a better chance at success. Regards, JH

It appears that way on the surface, but I think this is subject to country quota also. So until ROW EB3 clears(since EB2 ROW was current) possibly no spill overs. But the biggest problem with this 90K for 5 years is based on some math they did with pending LCs and 140s etc. However did they anticipate dependents numbers correctly which is unknown till 485 stage? What happens if the backlog is 450K + 100K(just an assumption) when dependent numbers are added? You wait 5 years and realize you were not cleared through this system because you were part of that additional 100K . Now you fight your battles in the point system with a country limit of 14K(10% of 140K). So there are about 70K(14K*5) numbers being used up in MBS during those 5 years for a given country, not sure if that is the saving grace for any kinks in the backlog reduction numbers, but you have to figure new people are coming in every year and will compete for these 14K Visa numbers. It will be 38K when Z visa holders become eligible, but that is still a lottery proposition at best. So this could be really bad for few unlucky ones. Even though we have 485 applications in the system, if the numbers do not work out a few people are gonna loose big time.
Best case scenario is that we all get through under the backlog reduction, but future generation from India/China will have to play lottery for GC's.
This year with overflows from ROW category, maybe 40K extra numbers were used for backlog reduction. Adding 10k for each china and India it makes the number 60K. Isnt 90K better than 60k (if we are lucky) under current system?

First thanks to those who put there first hand experience in this thread, it made me think again. And now I am deciding to cross the border and go north, after 9+ years in US on H1b.
Could someone please refer a Do-it-yourself kit that they have used and/or immigration consultant?
I contacted one consultant, they email almost every week and when I called/emailed them saying I am ready to pursue there has been no response from other side yet.
It will be great help for me if you could refer a kit or a consultant.
Looking forward to join H1->Canada community :D

If you filed early May and received a Notice of Receipt from USCIS, that means your I-485 is already in process, and you have been assigned an Alien Number already. The announcement from INS is very clear, "Effective Monday July 2, 2007 there will be no further authorizations in response to requests for Employment-based preference cases". It says EFFECTIVE JULY 2 and "NO FURTHER" right? That means the only ones affected are applications received July 2 and onwards.

If I understood correctly someone above said that just having your application in processing does not mean you have been assigned a visa so I can understand why people who have recently sent in their application would be worried. It makes them wonder whether the USCIS' claim that they're out of visas also applies to them. It may sound simple to you, but neither you nor anyone here really knows what is going on in their minds up there, there are only speculations. If we knew what was happening, there wouldn't be so much discussion.

I have been going through this discussion. I am in a similar situation where I got a Welcome Notice saying my I-485 was approved and I should be receiving my card in 3 weeks when my PD is not current and in fact, the PD is a couple of years behind! It has been 6 months since I got the notice and no GC is in sight. After calling the customer service in March, they told me that they did not have my biometrics in their system and so I had to go for a biometrics appointment early April. It is almost 3 months since then and I still have no GC card. I know that there is a delay in card production, but at the same time, I am wondering if the I-485 approval was by mistake and that is causing the real problem. I am in talks with a lawyer who suggests it is better to correct the USCIS mistake right now rather than getting into complications in the long run. I am frustrated that I have to pay for an attorney for a mistake USCIS did and concerned what will happen in future when I proceed with their advice.
Could one of you who faced this situation descibe how you handled the situation or how you would handle this situation? In my case, there is no other I-485 or anything filed before and I have never been out of status or had any issue ever.

Does anybody know how long an H1B visa can remain valid (including grace period) after a layoff ? What I know, is an H1B technically becomes invalid the day you stop rendering your services to your employer. The firm's lawyer suggested me to file for B1/B2 visitors visa to avoid going out-of-status.
If I do that, can I transfer my H1B visa (from B1B2) once I get a job? Or will I have to struggle against some quota?
Can anybody suggest a good lawyer in New York City or near Hoboken, NJ who can help we with all this? I tried contacting Cyrus Mehta, but he seems to be booked for another week.

Technically there is no grace period. Get a job ASAP and you need 2 pay-stubs for transfer.You can even do without pay-stubs but you may have to go out for I-94. Best way is to transfer to B1/B2 and you can come back to H1b without any problem.

let us say that the Fed suddenly comes out and changes the interest rates on the market, say from 5% to 8%. do you know what'll happen to it? it will cause chaos to say the least, and even worse. well, according to your reasoning, the Fed could say, hard luck guys, better luck next time...there are no rules binding the Fed to align interest rates to market expectations... - but guess what, the Fed tries hard, real hard to do just that - to keep interest rates in line with market expecations. it is a question of bringing stability and fairness to the system (in this case the market).
the same should be true of stupid govt immigration agencies. and if u call it luck, well it is time to change it, isn't it.

I do feel bad for you but I will say sit back as these things some time happens with every one. I am sure you will be in good shape as Backlog processing Center will be finishing remaining LC's very soon.

I am not a lawyer, but this is what my understanding: if your I-485 was is pending for at least 180 days and your I-140 was approved at the time when you used AC21, you should be safe. In this scenario, even if the ex-employer revokes your I-140, you should be fine and if USCIS has denied your I-485 based on this, you should be able to fight it.
USCIS usually won't deny a I-485 unless the applicant was out of status at some point of time. Sometimes, the attorney messes up the application somewhere and that causes denial. But again, as someone has mentioned, USCIS is suppose to issue NOID before denying it. If they haven't done so, this gives you an additional material to fight the denial.
I would suggest that you wait for the denial notice and see what it says. If it sounds complicated or you think the USCIS has made a mistake, get a reputable attorney and file a MTR.
After searching on google, i found almost 20 cases on first 2-3 pages itself indicating the denial notice and MTR.
I think they are just sending denials to put us in another limbo.... Its going to be the hardest and longest 10-15 days of my life........

Just called USCIS and told her that My application was mailed on Jun 28th and it got delivered on July 02. I also told her that my PD is May 2003 (hence i'm eligible to file in June)..
She told me that since i mailed it in June and this Notice goes into effect in July 02 my application WILL NOT be rejected... She asked me to wait for receipt notice :)

On Thomas most of the amendments were ordered to "lie on the table". If these amendments are not considered most of the sponsors & co-sponsors of these amendments may not support the final bill. That would be a good thing for us. Blessing in disguise!!
