Ask your attorney to write a letter in response to RFE and explaining the situation you never took the job with employer X though the H1B transfer or new is approved, this will clear the query of USCIS. One catch, you should have maintained a continuous employment with #2 and demonstrate the same to USCIS. Good luck!

My current H1B was sponosred through an educational institution and was hence cap exempt. Will I be able to transfer my current H1B if I decide to move to a private company?

When I spoke to my Lawyer about the same issue he said that if the H1B visa was never counted against the quota, you can not unless the visa numbers are available in the fiscal year. He also mentioned that the move into for profit company would be considered as a new visa and should counted against the quota.

I have flown in these airlines so far and here are my comments
Delta - Oh sucks man !! - Thiruvallur bus (in tamil it means - a normal congested government bus)
Qatar airways - decent - except for the food which is no good and you dont get the polite service (even they will not even check back if the light is on).
Jet airways -- wonderful ! Excellent food ! Superb airhostesses ! Good leg space and quite comfortable flight
Indian airlines - Oh man ! what a journey between singapore to chennai. We started late by 3 hours as they took one flight off (cost cutting) and bundled all of those pax with us. And we had to land on exactly 1 wheel (i meant with 1 tyre remaining). Nose wheel had tyres blown out and the back wheel had one blowout. But hats off to the pilot who took us safely. No bassinets, but the crew was cooperative and gave us a bassinet that could be placed down in the floor near your leg. I will vote against the machines (IA) but support the crew.
Singapore airlines - Awesome and hats off so far ! Had a tough time getting a bassinet for my baby as there was a code share with indian airlines (of all airlines - oh my god!). The indian airlines folks goofed up by not sending the bassinet request and food (vegetarian) to singapore airlines. But the staff was so accomodative enough that all the worries was sorted out effectively in the counter as well as in flight. Will always support them for their cooperation.

I am in EB2 ADP with PD Feb'09. No cheating there ! :)
I understand that if a lot of EB3 guys, who have been waiting for years, start porting to EB2, they will end up in the queue before me :(. And with that knowledge, I will still support EB3-EB2 porting.
EB3 guys, porting is your best option. I hear a lot of EB2 asking you to go get a new job where they are willing to
a. Hire you with your H1B status,
b. Agree to file your GC, and
c. Agree to do it in EB2 category. (Think about the min wage they have to give and prove etc.)
It is way easier said than done in the current economy. But if you find one, go for it. That is a way of respite for you folks. For others, try porting to EB2 with your current company.
There have been cases where EB3 was filed when the candidate was eligible for EB2 and there have been cases other way round too. But talking about none of them helps your cause. Similarly, fighting amongst us doesn't help either. Don't get me wrong if I say that with EB2 movement, if EB2 becomes current by the end of next year, EB3 will start seeing a good benefit of spill overs. So with current laws, getting EB2 out of the way will actually help your cause
Eliminating per country limit will help everyone. We should fight for that, EB3 and EB2 together.
Seriously try for porting. I have been waiting just a year, and already know how many decisions get put on hold because of this process.

I totally understand the push from IV to encourage state chapters and build grassroots strength to this movement.
Join the state chapter : IV does not have a state chapter in the state I live in - Nebraska,: So I thought I would start one and wrote to IV ...after initial response from IV , there has been no progress .
Start contributing: I have already contributed $100 and will contribute further as and when I can.
Volunteer for IV: Volunteered to start the state chapter.
Well I have done my bit so hopefully I will not be disparaged for making comments on this issue,
You must promote your state chapter by starting a thread and keeping it alive so those visiting the forums will know. (most people only look at latest threads)
