    Congratulations to everyone whose dates have become current. To all gurus. I wanted to know as to how does it work when it comes to procesing I - 485, what dates are important is it the filing date, or the Priority date? If two people file at same time with different priority dates who gets priority, one with earlier priority date or one with earlier reciept notice date or will the cases be treated at same level.

    Reciept date will not matter, as you can file on any day in the month of July. Earlier priority date will establish the preference. When dates retrogress, the PDs (priority dates) are again important. The date that is current will get the application processed first. Right now everybody can file, everybody will get EAD, AP but the actual application will be processed according the queue that is established with PD. I am not sure though. Check with lawyer.

    I came in 2005 and was eligible in 2006 for EB3 as per company's policy. There was huge retrogression then and I was hoping EB2 would be better for GC and career. Anyway, that's not the point.

    One thing I like is that people are acknowledging the porting is a loophole and plan to use it anyway since it suits them.

    Not convincing. 2006 was when Retrogression started. And it was declared HUGE only in 2007,8,9,10. Just because some Tom or D has forcasted that therez gonna be huge retrogression, we dont base our GC plans on that. Correct..

    If everyone were to go with your logic, then I guess EB2 qualified guys must wait for .. well how many years, u tell us.. to apply in .. EB1 ".. And what shoudl EB3 guys do..

    The point is, lets focus our energies on the main problem which all of us face, and not show any disgust on any one category. I know how it feels if someone is coming in front of me in my line.. But how can we stop them.
    Lets bring attention to releasing those wasted visas, quota problems etc..
    If equal spillover happens from EB1 to rest of categories, EB2 will affected immediatley.

    Shadegg Introduces ‘Skil Bill’ To Keep American Workforce Competitive
    Rep. Shadegg – “We stand to potentially lose the next technological giants like Yahoo! or Google if we do not keep America’s workforce competitive.”


    Washington, Jun 30 - As the United States works to maintain its economic competitive edge, U.S. Representative John Shadegg (R-AZ) introduced legislation yesterday to help retain the innovative minds of foreign-born nationals here in the United States.


    “We have benefited greatly from the many foreign-born scientists, engineers, health care professionals, and teachers that help keep America moving forward,” said Shadegg, a member of the House Energy and Commerce Committee. “To our detriment, current policy mandates that we educate and train these brilliant individuals and then send them away to other countries to compete against us.”


    H.R. 5744, The Securing Knowledge, Innovation, and Leadership (SKIL) Act, addresses this growing problem by increasing the allotment of H-1B visas, returning to the prior, higher level of 115,000, with potential for future increases. The bill would also allow foreign nationals who graduate from U.S. universities to stay in America and contribute to our economy by joining the American workforce.


    “Unfortunately, we are not graduating the number of Americans with advanced degrees in math and sciences that our high tech and medical industries need to compete. Until we can fix the problem of not having enough highly skilled American graduates, we need to pass the SKIL Bill.”


    Shadegg went on to say, “We stand to potentially lose the next technological giants like Yahoo! or Google if we do not keep America’s workforce competitive. We must maintain our edge by providing opportunities to highly educated and skilled individuals interested in staying here in the U.S.”


    In 2005, foreign nationals earned more than 40 percent of the master’s degrees and 60 percent of the doctorate degrees in engineering awarded by U.S. universities.

    This "anand" guy is a psuedonym for a Kim Berry crony for all we know.Old timers will notice that his distracting messages bear a striking resemblance to the folks who attacked IV core on the day of their CIR success. Such folks are not worthy of a personal response from IV core members - their time is too valuable for that. Hell, Roy Beck and Lou Foulmouth don't care to respond to our emails, do they ?

    Guys,
    Firstly thanks for the great show at DC, we are really beginning to bring this issue to the fore front. I could not attend myself but I did make a small contribution as a token of my support. However we should capitalize on the momentum and follow this up with some thing more substantial so that every one knows that this was not a one off spark but is a clear growing fire.

    I guess (just by reading posts on IV) one point which came out pretty clearly was that IV has good support in some regions and really very little support in some others (support as in visible support, where people are willing to show up for rallies, contribute to IV�s efforts etc), I guess this pretty much means that we need to focus on building the regional chapters of IV, like have strong/formal leadership and goals of each of the chapters.

    I was also thinking that we can possibly learn a lot from the protests by undocumented immigrants. They had record turnouts in their rallies and most of their people stayed away from work to take part in the efforts when ever there was a call for the same.

    I thought which keeps hitting me is about a simultaneous rally in all major US cities? I know that undocumented immigrants did this and that really worked for them and once again this will build our regional chapters coz the onus will clearly be on each of the regional chapters to achieve targets (target in terms of membership, turnout in rallies, fund raisings etc ) set by IV

    Some of the advantages of having simultaneous local rallies is that
    1) No travel expenses � (So that we can spend more money on media and lobbying than travel expenses)
    2) No need to time spent on travel � ( Better turnouts)
    3) Comfort � every one can just go to a local rally point (Better turnouts)
    4) Stronger regional chapters � (work at grass root levels)

    Also if this can be done on a Saturday then I am sure the turn out will be much better.

    IMO we should first try to form a local chapter. If that doesn't work try to combine forces with nearby states like IN, OH, IL etc. to form "Mid West" Chapter ( like New England and Tri-Sate Chapters).

    Co-ordination with IL chapter will be critical for us (and others too) in the coming days as Mr. "anti-legal immigration" Durbin is the senator there. We need to start acting - NOW - to convince him to drop anti-immigrant measures such as "barring H1Bs from consulting business"; instead of waiting on him to introduce his "Prevention of H1 & L1 Fraud Act" (and discuss it on IV ad nauseam without making the slightest impact)


    Someone suggested even joining the illinois chapter - maybe thats the way to if there aren't many here

    Thanks for asking.
    I am happy that we see a change. The Iraq war is not going well. I do not believe that Democrats are necessarily more qualified and honest than Republicans, but the balance of power is welcome.

    Regarding to immigration, my point is that I am certainly happy that we may see things moving - not because they will move directly suited to our category - but we may take a ride with the amnesty CIR bill. That is indirectly positive to us and that may turn out to be good thing indeed.

    Since the Democrat led bill is primary designed to satisfy employers looking for low income labor and supply democrats with potential voters in the future, my concern is that many of us may get into trouble ahead, when millions of illegal aliens get their cases in the USCIS queue. In addition, I have to observe that I have a long-term vision:I believe that an amnesty of this magnitute will bring the US to its knees in the mid-term. That is more a long-term vision, but that's what I think and if that is correct, that is certainly troublesome because that would make all my efforts to get a GC unviable at that point. I would not worry about that now. We need to finish our GC business and get out of this as soon as possible.

    Some members of this forum continue to distort facts. Nothing has changed for me. I captured all the information I had available back then and discussed with you all. In the last two months violence in Iraq has escalated to unacceptable levels and that has changed the outcome of the elections, apparently to our short-term advantage. It is time for a change for sure. Let's welcome the change.

    Again, I am planning to discuss our issues and constantly and deliver fresh daily comments to you all on daily basis. Let's hope that we will have more positive news coming.

    I do not understand what Ombudsman is trying to imply. Are you happy or unhappy about Dems taking up the house? We don't know what they''ll do but I definitely feel hopeful about it. Infact it was the dreaded house where everything stopped in the past. Two times in the past senate okayed bills with legal immigration and were voted down by members of ultra conservative right wing Republicans. I am sure anything will be better than the old house.

    The problem is, that for all my efforts, people just don't seem to care. The only reason I had any success was the embarrassment I caused the government because of all the soldiers who were excluded. Immigrants in the US are viewed by most people as an unwanted scourge.

    My employer has also been no help at all. I have been looking for work outside of the US, but unfortunately, the economic situation makes that a bit more challenging. Sorry if I sound pessimistic. That is just my personal experience.

    I agree with you, immigrants (legal or illegal) will always be viewed inferior in this country and we will always be immigrants. I am not sure if I want this tag with me, my kids, their kids all their lives. Sometimes I wonder if this GC path is even worth it. Going through so much trouble every time there is renewal, there is stamping, stamping delays, so much scrutiny, no certainity of coming back once you visit home country, so much even after living here for 6 years and now this back log.

    If you read any news on immigrants and read comment section after it, you will realize the hate from people here in this country. Is it really worth it to live in this country, when people here do not want to accept us? No acceptance in community, such high crime. Yes sure there will be some exceptions along the way who will rise to top.

    Just to point out the difference the amount of celebration among blacks after Obama won. Was there such kind of celebration after Sonia won or Manmohan became PM from their communities? This shows the kind of differences people have. I am not saying things in India are great, or else I would not be here. Just wondering on my random thoughts if its even worth it.

    The flower campaign was a huge success. The holiday season is here and I was thinking about a potentially new and innovative campaign idea. Greeting cards with a recorded audio message to be sent to the Director of USCIS. The message would be unique to the individual sending it. Should include something like "Dear Sir - I wish you a happy and safe holiday season. My name is "xyz". I am a legal immigrant stuck in the green card backlog for "xyz" years. Please help us. This message is just an idea - it could be anything agreed upon by consensus.

    Maybe this idea is a little corny but we have to think out of the box. Just imagine - hundreds of greeting cards with their own unique message - could make a point???

    I am also, stuck in this whole BEC debacle. Mine is Oct 2003 EB3 and still stuck in Labor. And the very fact that the FY 2008 quote availability is very uncertain and we might not be able to apply for I-140/485 for years now makes it even more frustrating.
    I am new to this team, so please tell me what I can do anything to help this issue to be raised.

    I am one of the victims here. I filed my labor on August 2002 EB2 and it is still waiting in the backlog center In-Process. I (w)hole-heartedly support for this...i guess we should send flowers to backlog centers...

    I am also worried. I called my attorneys office to inform them but of course like always he is in a meeting. I am sure this was an error but I am hoping its not call me optimistic but I like the smell of green card :)

    Hopefully, as others suggested, it is a case where they took your 2004 RIR labor date and approved your current petition when that date was current.

    Either way, wish you the very best.

    Every approval means one less wasted visa number; and one person out of the GC queue.

    we are a grassroots organization
    i think we take pride in the fact that the flower campaign originated at the grassroots. let's not forget though

    1. without "iv" as a whole which is all of us, the flower campaign would not be a success
    2. flowers alone did not reverse the desicion. a lot more happened including lobbying. don't forget what congresswoman lofgren did...

    moral of the story: if we all work together we can succeed, just talk is useless. and a many pronged effort is needed. this is not going to be easy...
