If anyone knows the history, this is pretty much happenned to Family based visas. 20 years ago, it was as easy as 1-2-3 and ppl use to get GCs in matter of months or 1-2 years. INS realized this and they started imposing processing dates and delays and what not and as it stands today, it takes about 10 years to get GC on family based.
They may have same plan in mind that instead of paying unemployment to PRs and Citizens, let's kick out the smart ppl who are stealing all the jobs and now their country is taking some of our businesses too.

Is it possible to get an emergency AP 90-days after the renewal application receipt date?
The reason I'm asking is because I would like to purchase airfare now for travel in January .. but am concerned that my AP won't be approved within the 90-day period USCIS mandates.

I don't personally think we had much media coverage except some hidden links, can we post some paid adds where everyone can get know what we are addressing in here i.e., on the front page of google, yahoo, msn, cnn, etc. I know some people might have second thoughts as it involves $ but I'm ready for it to get public attention. There is a thin line between legal and illigal and they are ready to club both together for their benefits. I'm starting to wonder how many people know what is going on, we have to educate them first.
Just to give everyone an idea, the cost of the 300x25 ad on MSN Homepage is $300,000 - $800,000 for 24 hrs. The range varies based on timing, day of the week, seaonality etc.
For the holiday season, it will be about $700-$800K.

I and my wife got our approved EADs in our hand in 17 days (Mailing day to USCIS to recevied date by us). Only strange thing is that my EAD is valid from 06/2008 to 06/2009. I thought the new EADs validity would begin when the existing expires. My existing EAD expires on 09/19/2008. I lost 3 months with this renewal.
USCIS has been unfair in renewing EAD.
What about writing a letter to them? - by grace of God, if they do realize, they may give properly - for 2 years.
Nothing wrong in trying.

I think desi3933 is right -- that one cannot file AOS without PD being current. However, this does not mean we should give up pursuing our goal. The secretary of DHS specially made it clear that she is willing to push for changes both regulatory AND legislative. But before putting in any effort, she will need to know what changes to push for. She even specifically mentioned the issue with pre-application of AOS, which seems to me a real good chance to get the message delivered.
Just for starters, here are the benefits I can think of about pre-filing of AOS:
- By having all applications on file, let USCIS better predict case load and allow DOS Visa Office to make informed decision on Cutoff Date movements
- Create more revenue for USICS (DHS) via AP and EAD applications
- Reduce the work load of Overseas Consulates when applicants with AP does not have to apply re-entry H1B visa.
- Many H1B visa holders have to go through the administrative procedure when applying re-entry visa. This process is more or less a duplicate with the background check required for green card application. When the applicant is allowed to travel with AP, the effort of background check is consolidated and allow resources to be better utilized.
- EAD allows applicants more freedom to change job, this will results in better resource distribution to accommodate the rapid changes of the economy, and it makes the market the most important factor to determine wages.
Please add whatever you feel missing to the points and maybe we'll come up with a formal letter to communicate to the secretary.
Last, to address the concern that USCIS may be flooded by AOS applications from freshly off-the-boat H1B's, restrictions need to be put on the qualification of AOS. What I could think of is:
- Must have approved I-140 (immigration visa. I think this restriction makes the most sense)
- Must have priority date older than a certain number of years
- Must have been in the US legally for five years
- etc.

(3) an immigrant visa is immediately available to him at the time his application is filed.
Explanation - At the time when the application (i.e. I-485) is filed by applicant, an immigrant visa is immediately available (i.e. PD is current).

Most EB2's who are talking on this forum are idiotic, egostic and too much of themselves to think straight. Case in point Smugbee, SNathan and TonyHK. Since they don't have ead they want ead and thats all they care about. As long as they get to file 485 and get ead they dont care.
When an eb3 complains about waiting for GC he/she is a whiner and has to recognize the superiority of an EB2 getting GC before EB3 even if teh EB2 is 1 year in thsi country and EB3 has been waiting for 12 years.

We have seen in the past years EB3 ROW got huge visa bonanza at the cost of EB2 I & C. And now apparently EB2 I & C is getting rightly deserved visa bonanza.
How about asking DOS to give similar visa numbers to EB3 I & C as a one time exception. I know people will say it is against law, but in my opinion law is fuzzy enough for this to happen.
DOS can give explanations like "Visa numbers will be given to oldest PDs or some thing". Per my calculation EB3 I needs 68K visas to move past 2003.
We (IV) may have to make representation to Secretary of State and try and convince her.

Hello IV members,
First I want to congratulate all the IV members who worked really hard to make this rally a success.Unfortunately I couldn't able to attend the rally.but I have contributed $100 for the rally.I think it is a good idea to make rallies in all the major cities on same day and show our strength.Head count matters in grabing the media attention.
I live in sunnyvale,CA and i'm interested in meeting the local IV members in person this week end to discuss further course of action.I will put 100% efforts to give my best for this cause.

Thats right, eventually when the H1B emploee gets Employement Authorization through GC process, the H4 spouse automatically becomes eligble to work and have better opportunities than any H1B holder. Why can't a H4 have a work authorization same as J2 or L2 or E2. Does ImmigrationVoice considered this thought and thinks as a good point to raise it to the senate in one of their efforts?

Again what is the point in moving to Canada just because you are tired in waiting here. Are you going to do the same job in Canada. If yes, I would do that here.
For me, only person who could move to Canada is:
1. Way better career jump.
2. Do not have wavery mind of coming back to US. If happens come back, but do not start with that as you will not lead happy life.
3. Keep the GC processing alive in US.
I think Canada might be a good option for some ppl. Here are some reasons:
You move to canada, have greater flexibility to change jobs, your wife gets to work, in the meanwhile your employer lets the GC process continue. This way, you live a free life until you get a GC. But I seriously doubt if any employer will continue to process GC if you leave the country.
Or you have waited long enough and are too tired to wait any longer. You would rather be elsewhere. In this case it doesn't matter where you go, Canada or back home.
Another good reason can be that you have waited for 8-10 years in US and have no hope in sight. You are not tired but you can clearly see that the wait is completely futile and you are just hoping. You have decided to stop waiting but still want something that's close to US standards. And I think canada still comes very close to good standards.
What do you guys think?

Depends on the situation one is in .. May be they wont leave seeing this bulliten but may be forced to go back after a few more ..
