    Good Idea, Jayram.

    Having even a couple of fill time staffers will make a big difference...but will also require bigger budget.

    Does any one know how much IV collets in recurring contributions? How much did we collect for the DC rally and how much did we spend?




    San Jose was a local CA event planned almost spontaneously. DC was an event planned months in advance. People were offered Free ride, Free plane fare, Free food (in Gurdwaras). Yet how many participated?



    I have been refraining from posting on this point, as I wouldn't like to belittle the contributions of the strong team from California and the numbers they brought to the rally.

    But let's face it. CA has more EB immigrants than the next three. Look at the recent 2006 Performance report from DoL (available at Mathew Oh website). CA had 21,000+ labor petitions compared to NY - 7,000, NJ - 7,000(?) , TX - 5000. As you can see CA scores more than the next three states put together.

    If 40 people participate from NY, it's as good as 120 from Cal. Percentagewise it would be the same. If 40 peope walk in Michigan ( 2000 Labor petitions) statistically it would surpass CA, percentagewise.

    It's a known thing that only 5%-10% of the population participates actively in the most successful movements be it American Revolution or struggle for Indian Independence. We haven't reached that critical mass yet ( at the regional level)



    There is an enthusiasm right now. But how long before the fatigue sets in? Rallies need to be minimal, held with certain strategic target and should serve some specific purpose.

    Weekend rallies attracting bigger crowds is a myth. Be prepared to listen to reasons like - Shucks I have to mow the lawn, take kids to Bharatanatyam dance classes, I have relatives over for lunch etc.

    With that logic if we hold rallies over the LONG weekends, we should attract bigger crowd, since people have 2-3 days to relax afterwards. And since people already plan to visit Orlando, LA etc to visit Disneyland, Universal etc., if we can hold rallies there we should attract the highest possible crowd. Do you think my idea will work?




    I agree with you 100%. Question is - who'll bell the cat? Who will take the lead and sacrifice their time, family life etc. to plan, organize and conduct these?

    We need a fearless leader like Aman Kapoor, who can motivate and inspire people to participate, in every state. Where can we find them?

    How about taking this to the next step and hire paid fulltime staff who can
    1) call people and request donations
    2) organize meetings
    3) stimulate the local chapters
    4) promote IV
    ..... and the list can go on.....and do all the things necessary to convert all propects to customers.

    How about having full time offices in DC? This office will run on donations.

    Finally, how about instead of anonymous members make this a place where everyone has to provide their personal details etc.

    Anyways, I am just ranting.

    Here is an update on Visa recapture from Aman:
    "I know some people ask for achievements of Immigration Voice and comment, sometimes ridicule, that Immigration Voice has not been able to get even one provision in last one year. There are many other organizations working on behalf of various groups. If no immigration provision has passed in more than last one year, does it mean that all those organizations are also ineffective? We all know that this is a world of instant gratification but please understand that there are groups who go to DC to get their issues addressed and they wait for 2, 3 -5 years before anybody would start listening to their issues. You see, just to explain using an analogy, Microsoft is working to get H-1b numbers increased long before Immigration Voice started. If Microsoft has not been able to get Congress to increase H-1B numbers, does it mean that Microsoft is no longer an effective corporation? Likewise, Immigration Voice has made significant progress but due to the political climate and statistical discussion about the undocumented, which of’course is different but an important issue, our provisions are clubbed in the comprehensive bill. If it would have been any other year when Congress was not considering the issue of undocumented or comprehensive immigration reform, advocacy effort of Immigration Voice would have definitely translated all our provisions into law six months back.

    If you want us to get Visa recapture as interim fix, allow me to share with you that as it stands today, it will not happen outside of Comprehensive bill. Infact as it stands right now, even H-1B increase will also not happen outside of comprehensive bill. Reason? Most of the groups and companies have stopped pushing for temporary relief because any kind of temporary relief or interim relief chips away support from CIR and the offices of Senate and House Leadership along with other proponents of CIR have made it clear that any immigration relief has to be a part of CIR and not outside of it. Other companies/coalitions have stopped pushing for temporary H-1B increase as they do not want to be in the bad books of committee chairmen and the leadership offices by trying to sneak temporary relief that divides the supporters of CIR. Leadership wants support for CIR and want all sides to wait for CIR. And not doing so and trying to get interim relief before CIR would put them in bad books of Senate and House leadership, which no one wants coz if CIR fails, then after CIR, these offices will not co-operate with any group that tried to take away support from CIR. So it would be counter-productive politically to do things that take away good stuff from CIR. Also, if you think that any effort in the final week could help in anyway, then let me to share with you that most provisions and their language are decided much in advance and last minute efforts almost never yield any result on the Hill."

    This is certainly good news for many. However the skeptic in me is feeling very uneasy. Why did they suddenly open the flood gates? Did they purposely create a backlog and then increase the fees (double the fees) just in time? Are we going to face other issues down the line after applying for 485?

    I guess for now, we will just celebrate and try to get our 485 applications in before July 31st. After that it is a wait and watch situation.

    Congratulations to all who got through this first hurdle.


    If you overanalyze any situation, for the matter even, "why come to work?", one will always find consipiracy :)..

    I say lets not overanalyze this and lets celebrate and keep our fingers crossed for avoiding any further issues !!..

Look beyond the marketing of lawyers and see their skills, track record and genuine concern for your long wait. You are asking the same lawyers to help you whose bread and butter comes because you are applicants in a long line.

    Do not depend the processing of your papers entirely to the lawyer or their paralegal. Be proactive. Always demand a copy of the application prior to the actual filing. You will be shocked to see so many errors. It's also good to check IV news once in a while. If it wasn't for IV updates, our company would not have been able to correct our lawyer's mistake in filing for my H1 extension. He insisted that USCIS never grant a 3-year extension even if I-140 approved. I showed him IV success stories and he apologize for his error.

    Remember, lawyers look at their clients as $$$. The more services they can create, the more $$$ they can get.

    I never imagined that the journey to GC would be such hard, and I have to give my whole life following these notices and EADs and what not. USCIS cannot approve my GC for years and years but now abrubptly they approved my EAD in less than 15 days, when I was expecting to get 2 years extension. My EAD app. was sent out on june 9th and my lawyer told me that they saw approval from yesterday 6/26 (wow 16 days including shipping!!!). USCIS always has hidden agenda, and everybody can tell that it is just money, which leads to such decisions. No body would forget last years july fiasco when they hushed up GC visa numbers for rendering people not to apply before fee hike. The present EAD issues everyone is reporting here is another fiasco. I wonder if there would be barrage of lawsuits for EAD fiasco as we saw last year for july fiasco. Now I understand why USCIS gave themselves time till 30th june, otherwise why wouldn't they make 2 year EADs effective right from the day of announcement in early week of june. Smart move!

    Oh well this is what we have to face till we get that "Gone Card"! Day by day my patience is losing. Is it worth all this trouble?
    i dont get it...the ead card is valid for a year. you are paying money for 1 year. Instead of being happy that your file has not been lost and have received your ead on time...you are going on a conspiracy theory rant.

    Just ask those people who havent received FP notices or havent received their EADs for the last 90 days, what they are going thru. At times we have to count our blessings rather than thinking what we have lost. the 2 year EAD is not your "right." Your "right" is to a 1 year EAD that you PAID for. If one gets a 2 year EAD, its a favor to them done by USCIS.

    I dont think one can or should DEMAND favors.

    Somebody has to pay for the govt's bills..
    Feds have virtually lifted all grants and support to USCIS as they have to fund their other projects. USCIS was asked to be self sufficient. I also read it somewhere that they are pressured to fund some govt. projects. How that will come ?? Skin the immigration seekers...beat them, whip them.. after all it's their choice to live here...
    How can anyone explain this now? Isn't it a money scheme? Is it reasonable to loose 3 months when you had already paid for it? There is always confusion in this whole GC affair. There seems no option than to live with it and move forward.

    Assuming thay the information they will share is what all of us are seeking, it is not going to be a bad deal if we can find 500 people willing to chip in for this initiative (I am an optimist guys).

    If they are going to give out the information, then it should be ok to pay $5k.

    Questions are:
    a) How soon will the work be finished?

    Thank you for sharing with me your support for comprehensive immigration reform. I appreciate hearing from you and share your concerns.

    While the United States cannot afford to absorb all those who want to settle here, we are a nation of immigrants. My mother came to the United States from Lithuania with her parents when she was two years old, and our family created a new life in Illinois. It is a testament to the greatness of this nation that the son of an immigrant can rise to represent the state of Illinois in the Senate.

    At the same time, our nation faces a host of problems as a result of years of inattention to our immigration policies. The Homeland Security Department estimates that about 11 million people in the United States do not have legal status, including those who enter the country illegally and those who overstay a temporary visa. I have worked to reform our immigration system comprehensively and in a way that is tough, realistic, and consistent with our moral values.

    I recently joined a number of Senators in releasing a blueprint outlining the basic principles that a comprehensive reform bill should include. The measure would improve border security by increasing manpower and deploying new technology. It would strengthen enforcement against employers who hire illegal immigrants. Today, undocumented workers are often exploited by employers who hire them. Strengthening the penalties for employers who hire undocumented workers will ensure that both immigrants and citizens who work here are protected by our wage and labor laws.

    If we are serious about reform, we need a realistic approach to the millions of undocumented immigrants who already live and work in our country. We need to offer immigrants who work hard and demonstrate a long-term commitment to be law-abiding, contributing members of our society a chance to pay fines and earn their way to permanent legal status over the course of many years.

    If we do not give people who are already a part of our communities the chance to earn their way to legal status, we will not solve the problem of illegal immigration. People who are living here illegally will stay in the shadows instead of coming forward to register.

    While immigrants often enrich our communities, an employer's first job offer should go to any American who is willing and able to fill the job. I have been concerned about the potential impact of past proposals for temporary guest worker programs on the American workforce. In many industries, the assured availability of large pools of guest workers will give employers an incentive to pass over American job applicants in favor of foreigners willing to work for less pay and fewer benefits. During the immigration debate, I offered a Hire Americans First amendment to require employers to seek American workers for their open positions before they try to bring in guest workers. I have also introduced legislation to combat abuses in the H-1B visa program.

    There is no perfect solution to the problems we face as a result of our broken immigration system. Today, our borders are not secure, our workplace enforcement laws need reform, and our immigration policy fosters a shadow economy for millions of immigrants who simply want to demonstrate that they can be hardworking contributors to the greatness of our country.

    I will continue to work for a package of reforms that will protect American workers and that will be tough, enforceable, economically sensible, and morally defensible. I will keep your views in mind as the debate continues. Thank you again for contacting me. Please feel free to keep in touch.

    Good to see and hear about the pros and cons of Logiclife's post. Both sides are valid and rightful in their own way...

    However there are goals that need to be achieved for this grassroots organization and it is just not viable for just a few dedicated people to achieve it. Is it wrong on their part to appeal/call out for help? By the way this is not for the benefit of just a few people. Whoever comes to this website will be benefited by the outcome of the efforts.

    No one is demanding anyone to just volunteer. Logiclife's post might have shown emotion and for members like Ram (with all due respect) it might have seemed unprofessional....but this is not a corporation which is run on a profit/loss basis. It is a people's organization solely to benefit the members. Emotion and dedication are a major part of its survival. I am not a leader but I do my minimum.

    1. Contribute financially.
    2. Spread awareness among friends and acquaintances in similar position.

    I respect all the people who responded because I am sure they might have contributed in some way. For the others, please do more than visit the site for just updates.

    Thank you all for the quick and helpful replies.

    My current employer has assured me that they will not revoke my LC or I-140. It is a huge company and I think it will stick to its word. It will not have any use for the LC, I-140 anyway as the whole group was laid off and the product moved to India.

    So, it seems that if I transfer to company B they will be able to file for an H1 extension beyond 6 years based on I-140 approved with company A. I can then start my GC process with B again while keeping my old priority date.

    Here is my take on usabal, the firm is well known in the Bay Area, so if you are in that area, you are ok.

    For TX, they acquired the firm Jenkens and Gilchrist last year. Jenkens attorneys are very conservative, and if you happen to work for a big employer who has hired Berry, Appleman... you are screwed.

    They may still work out ok for you on an individual basis, I would stay away from their TX office for sure.

    Berry, Appleman & Leiden LLP is very good firm. I have very good experience with them. They completed all my paper work on Jun 30, so that they can file by July 2.     Also on another note Senator Lieberman wrote a piece in investors.com which is pro-skilled worker and pro-H1B.

    In it he says "When the Senate resumes debating comprehensive immigration reform this week, I will fight to exempt from the cap foreign nationals holding a U.S. graduate degree in any field; a non-U.S. graduate degree in science, technology, engineering or math; or medical-specialty certification based on U.S. training. Taken together, these reforms would deliver much-needed relief � and vital human capital � to our innovative industries." .


    This is a good find. I'm happy that the senators are fighting to remove the cap for masters students. That would make lot of room for the non-ms students.

    Hi,
    Based on the summary if you re-look at the student visa section of Bill Frist's bill

    `(2) STUDENT VISAS- Notwithstanding the requirement under paragraph (1)(C), an alien may file an application for adjustment of status under this section if--

    `(A) the alien has been issued a visa or otherwise provided nonimmigrant status under section 101(a)(15)(F)(iv), or would have qualified for such nonimmigrant status if section 101(a)(15)(F)(iv) had been enacted before such alien's graduation;

    `(B) the alien has earned an advanced degree in the sciences, technology, engineering, or mathematics;

    `(C) the alien is the beneficiary of a petition filed under subparagraph (E) or (F) of section 204(a)(1); and

    `(D) a fee of $1,000 is remitted to the Secretary on behalf of the alien.

    `(3) LIMITATION- An application for adjustment of status filed under this section may not be approved until an immigrant visa number becomes available.'.


    What this really means is a masters student can adjust to immigrant visa status although his visa application will get approved only when the visa is available. If i have understood this correctly this means that this is similar to the S-1932 provision wherein you can adjust your status although approval will happen only when immigrant visa is available.(provided one is masters)

    Or have i got this wrong?
    Comments? If i am interpreting this correctly it is another big boost for people who have either not worked 3 yrs as yet on H1B or have a masters degree unrelated to the profession they are working in.

    Thanks for listening, I googgled to see if there are others like me and how the mess was solved.. I dont want to have problems down the line when naturalization comes around.

    If it turns out that GC was indeed approved erroneously, I will return it and that goes without saying...but who can tell how long will re-instating of AOS take and also I wish to know how I can keep my H1 from being denied. Luckily I am still with GC sponsoring employer, but ...still, I did not need all this hassle..

    I know I have received approved RIR Labor in June 2004 (it was for the same category EB3 ROW), but I do not know if the company filed I-140 or not. I will have to dig up old contacts from the company and inquire...But that was 6 yrs ago and I am not sure where people are...
    Anyways, I will try to patienty wait to get the hard copy of whatever USCIS is sending to check for Priority Date, and if it is not what I expect it to be (Nov 2005), I will call TSC to inquire.

    When you are returning the erroneously approved gc, make sure you write a cover letter indicating not just the return but also the need for your AOS to be reinstated as soon as possible and not delay your gc process. Tell them not to mess up your case without being rude..
