Could not agree more. We are masters of everything related to caste, quotas and discrimination and we need to fix our own house before complaining about other countries, airlines etc.

Hello,
I'm also in the same situation. My labor is approved May 2007. I'll need to apply for both 140 and 485 together. Can I do it at the same time ?? or do I need to file my 140 immediately and then 485 after a few days. Time is running out now, as we never know when USCIS would again stop accepting 485s. Please advice.

I think you can file I-140 and I-485 at same time. You no need to worry.

I agree that porting to EB2 is the best route. But my company was very reluctant to file another labor to port my case to EB2. They thought thur PERM, they may have to hire some applicant if they meet the requirements. The lawyer thinks PERM is risky. I know they are trying to avoid EB2 labor at any cost, though I also know a few friends who had the PERM labor application recently rejected.
Anyway, bottom line for me and others in the same situation is that we are stuck with EB3. And maybe stuck in the rut for a long long time unless something magical happens....

No you can't. You must have filed separately. You could have amended your return to file jointly, but not the other way around.

(IRS website also says if u do so, you dont have to return the stimulus benefit - unfortunately this clause was added only on 04/14/2008!! according to IRS website).

It appears that way on the surface, but I think this is subject to country quota also. So until ROW EB3 clears(since EB2 ROW was current) possibly no spill overs. But the biggest problem with this 90K for 5 years is based on some math they did with pending LCs and 140s etc. However did they anticipate dependents numbers correctly which is unknown till 485 stage? What happens if the backlog is 450K + 100K(just an assumption) when dependent numbers are added? You wait 5 years and realize you were not cleared through this system because you were part of that additional 100K . Now you fight your battles in the point system with a country limit of 14K(10% of 140K). So there are about 70K(14K*5) numbers being used up in MBS during those 5 years for a given country, not sure if that is the saving grace for any kinks in the backlog reduction numbers, but you have to figure new people are coming in every year and will compete for these 14K Visa numbers. It will be 38K when Z visa holders become eligible, but that is still a lottery proposition at best. So this could be really bad for few unlucky ones. Even though we have 485 applications in the system, if the numbers do not work out a few people are gonna loose big time.
Best case scenario is that we all get through under the backlog reduction, but future generation from India/China will have to play lottery for GC's.

I don't like getting my ass kicked. Hence, I refuse to fly Air India.
Last time I flew that Airline (Boston - Heathrow - Mumbai):
1. The crew disembarked at Heathrow. The transit passengers were not allowed to disembark.
2. The crew shut off the heat/power and opened the Aircraft doors (yes, it was winter).
3. They sent the cleaning staff in to clean/vaccum the plane with a lot of passengers seated.
4. At Mumbai, the airhostess was in some sort of a hurry shoving the passengers so that she could disembark first.
I've never had such experiences with AF. They are not racist. Airlines are not allowed to issue transit visas and anyone who has lived in France can tell you how insensitive and lazy their bureaucracy is.
Bad flying experiences do not equate to racism. It is strong word to use and I do not think it applies to this case. Yes, I have seen French show racism towards Africans, but this is not one such case.
There is a reason why Indians are required to take a transit visa. Coz, in the past there have been Indians (at EU airports) who have claimed that they have lost their memory, do not remember who they are, don't have any ID and hence qualify for asylum on medical grounds. Now these gov'ts are requiring ALL Indians to have a transit visa so that if anyone pulls such antics, they have all the information that they need to identify the individual and deport. Some bad apples have f&^%ed it up for all of us.

But the burden here lies on the Airline Carrier, regardless of whether Indians have suddenly lost their passports or their memories, you simply cannot categorize everyone.
And this exact attitude is why we dont respect each other.

Even if this was true, it is the airport authorities at CDG or AF staff that should be managing that. Bcos of some history, every indian was treated like a dog?
And it is shitty that you are siding the AF guys, when your countrymen were illtreated. The attitude should be, I will first take care of my own brother and believe what he says, rather than going into the righteousness, which can be bent.
I will bring an incident from the Clinton administration.
There was this american arrested in Singapore for eating and spitting chewing gum on the streets of the city.
The president personally called the PM of singapore and got this person out, who was just an ordinary cirtizen, who actually had broken the law of another country.
So, I will believe whatever the Indian is saying over what the AF guys is saying. period.

It's not 10 or 20 years ago. 10 or 20 years ago, US is the best place in the world to stay. But now, it's different. My friends in US make about $150k a year and cannot afford a luxury lifestyle. I make $100k a year and enjoy a very comfortable life in China. I built my own house in China, which is even better than my house in New Jersey before. I hired my own chauffeur, housekeeper, two nannies for my baby... I cannot afford these thing if I were still in US. How many americans can afford the same lifestyle as mine? I don't think there are many.
My point is, be open to opportunities in your own countries or other countries in the world other than US. You will be happy to leave US several years later when you look back. Besides, if more and more US-trained scientists and professionals come back to their own countries and help their countries to develop, maybe in another 10 or 20 years, no one would want GC anymore."

However, if we take all these letters to the press..and have them run the show for us....also by keeping the confidentiality of the individual....Guys one letter from the guy who was fired from Microsoft made news all across cnn, yahoo and everywhere.....Let the press of US do the job for us....they will make USCIS accountanble. I lilke the idea about taking to the President or Sec of State....actually, if we take to the local Senator...that will be good enough....all these guys are always looking for spice reports like this to make things happen...Hopefully this will bring more transparency from USCIS and they will be forced to report status to the Govt, by which we will also see what we need to see.....

I'm hoping that since you anyways plan to be in Troy that day, you can try to attend for 15 minutes-30 minutes and then leave for your friends ceremony. I don't think the meeting will be a whole day afair. It might last half an hour to an hour max. Please consider the possibility of partial attendance, if possible, while attending your friends marriage - as every extra member attending the meet is a moralebooster to the rest of us.

Speed of approval is not the problem. The NUMBERS are the problem. We saw that in June when so many ppl got approved.
To me "SKILLED & DIVERSITY" doesn�t make any sense. They should not go hand in hand.
That is actually not true. Approval will not become quicker if speed is not improved.
The ONLY reason there were a LOT of approvals in May through Sept was that there was a sudden jump in PDs that allowed a LOT of people whose applications had been approved pending visa availability could finally be assigned a number. USCIS didn't all of a sudden dramatically increase their productivity, there were just a lot of people waiting for that number.
Of course, Numbers matters too - but more numbers without extra speed will get us nowhere. If that were to happen, there would just be more visas wasted each year that we'd be asking for recapture
