:) i understand your point and agree a bit, but gandhi wasnt into programming, he would have been sucessful no matter where he went. He had a unique vision, personality etc. we are average people with school going kids (try asking a 10 year old to learn 2 new languages all of a sudden and pass that subject in class) trying to establish ourselves somewhere. i mean if we have to go back we will and we will adjust and succeed.
the only thing that holds us back is...do we want to give up after waiting so long (8yrs in my case) and once we leave, we have effectively lost our position in the GC line...sort of no turning back.

I think this guy is from numbers usa for sure. After writing all the BS, he asks it to take it in constructive way. There are lots of other way to express your concern if it had to taken in constructive way. This is definitely not the way.

I don't like getting my ass kicked. Hence, I refuse to fly Air India.
Last time I flew that Airline (Boston - Heathrow - Mumbai):
1. The crew disembarked at Heathrow. The transit passengers were not allowed to disembark.
2. The crew shut off the heat/power and opened the Aircraft doors (yes, it was winter).
3. They sent the cleaning staff in to clean/vaccum the plane with a lot of passengers seated.
4. At Mumbai, the airhostess was in some sort of a hurry shoving the passengers so that she could disembark first.
I've never had such experiences with AF. They are not racist. Airlines are not allowed to issue transit visas and anyone who has lived in France can tell you how insensitive and lazy their bureaucracy is.
Bad flying experiences do not equate to racism. It is strong word to use and I do not think it applies to this case. Yes, I have seen French show racism towards Africans, but this is not one such case.
There is a reason why Indians are required to take a transit visa. Coz, in the past there have been Indians (at EU airports) who have claimed that they have lost their memory, do not remember who they are, don't have any ID and hence qualify for asylum on medical grounds. Now these gov'ts are requiring ALL Indians to have a transit visa so that if anyone pulls such antics, they have all the information that they need to identify the individual and deport. Some bad apples have f&^%ed it up for all of us.

All that is being said is very true. Petitioning the US gov't is as American as apple pie. As aspiring Americans we can only be respected for this, if we do it politely and peacefully.
People who put in a herculean effort (not to be underestimated by anyone here) to organize the rally and surrounding activities, broke their backs trying to lay a platform for the rest of us to communicate our case. It is only natural that when they get the lamest of lame excuses, they feel upset.
Every one of us has skin in this game. We need to find some way to lend our weight to this issue rather than just passing time on this or other websites. It is really unclear to me why in America, the most free society on the face of the earth, people feel unmotivated, inert, insecure etc to press what is a most legitimate grouse.
Let me give you a few points that might convince you in this issue. For most of us:
1) We are here at the behest of our employers or the US Gov't (NIW cases). Not on our own accord or illegitimately.
2) The US gov't has certified that our jobs do not have suitably qualified americans to take them.
3) The US Gov't has approved our immigrant petitions.
4) We are in a period of inordinate delay to complete the steps due to a variety of factors, including bureaucratic delays, inordinately long security checks(BTW bad for both us and the country) and an inadequate supply of visa numbers for the number of approved petitions.
5) We are asking the US Gov't to fix this issue and treat us fairly and not make us wait 6-10 yrs for no clear reason.
6) We are asking them to be more straightforward in their policy and to stop sending mixed signals.
Above all we are doing it in the most American of ways. Peacefully petitioning and lobbying the government. Most broad minded Americans can and do relate to this.

I hope this amendment will pass as it was proposed by important senators like, Chairman of Judiciary committee Mr Leahy, Mr Cornyn, Mr Hatch. This alters the equation completely. If it passes, the total EB & Merit based visas are 387,000. The total EB visas as per old system will be 230K.
Merit based system: 247K (147 for newly created point based +90 K to clear backlogs)
Employer Sponsored System (as per amendment) = 140K
Therefore 230K is available as per old EB system. Apart from that, most of the EB1 and EB2 guys and the dependents of EB visa holders will be exempted from numerical limitations. This is the proposal we should support.

If the above is true then we should be in good shape as % per eb category is increased and masters exempt.

Visa Portability (as per AC-21) allows one to start employment after filing for H-1B petition, before H-1B petition os approved. only if he already has a approved H1b from other sponsor
H-1B Transfer does not invalidate current employment status (if on H-1B status) and beneficiary can continue working for original Employer A based on that I-797 validity dates. (status remains same due to transfer... but the question is whether some one can work for a non sponsor? My take is NO.)
OP needs to explain to USCIS that he never switched jobs on new H-1B approval and continued job on the basis of original I-797 dates. He was not out of status.

I think I-485 filing clause is needed. Please note that the USCIS is not staffed enough. So there is a high possibility that the priority date retrogression will continue even if all the current provisions included in the Frist bill is passed. They will retain the retrogression in order to control the number of applications. In such a scenario, it is important for us to try and introduce the I-485 clause, so that people could get their EAD while they wait for USCIS to clear the mess. My 2 cents.

This little time and money is nothing compared to your next few visits to your attorney's office when is time to renew that I am sure you're tired of doing.

I understand that it might be late and filing a case might be expensive etc. But how come people like murthy.com etc. were willing to fight the sudden revoking of I-485 by UCIS along with AILF? It will only be hypocritical to consider that as injustice and this as not. I don't think filing a case is going to bring the whole process to a halt. The BEC will still continue to process the cases while this case goes on.
We have to do away with all those naysayers and all those IFs and BUTs. I don't belive in it.

Well I filed under Rest of World" and EB2 back in August of 2006 when it was current for me (it�s always been current for me since then). I filed both my I-140 and I-485 together. I have done the fingerprinting etc and even replied to a RFE for my I-140 (well my company did). On June 1st I got my company to submit an "out of processing time" request which gives USCIS 45 days to come back with a decision or reason for not approving it. Now after all this fiasco my lawyer is telling me that my I-140 will continue as per usual (since it's not affected by all this) but my I-485 will not be approved until after October 1st. I don't agree with him, I believe part of the 60,000 visa numbers have been allocated to those that are pending and current (so they haven't been approved but have already been allocated). Does anyone agree or disagree?
Under normal scenario you have to wait until your 140 gets approved But during the past 12 days they could have approved your 140 just to approve your 485 tooo.. Keep checking your mail box every day and good luck;;;;:D :D :D
